En este devenir, la propiedad intelectual y, particularmente, los derechos de autor también están sufriendo cambios a raíz de las nuevas tecnologías y de los nuevos medios de compartir y transmitir las obras. El legislador europeo, en aras a proteger el desarrollo tecnológico, se inclinó por proteger a los prestadores de servicios de la sociedad de la información (PSSI) mediante una exoneración de responsabilidad recogida en la Directiva 2000/31/CE, del Parlamento Europeo y del Consejo, de 8 de junio de 2000 (Directiva de Comercio Electrónico), que, basada, en su momento, en modelos jurídicos del mundo offline, en la actualidad no sólo ha quedado desfasada, sino que, en ciertos casos, se muestra insuficiente para una adecuada protección de los derechos de autor en Internet, al igual que ocurre con su transposición en nuestro Derecho, plasmada en la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y Comercio Electrónico. A ello se añaden las dificultades que entraña la protección de los derechos de autor en Internet, cuya tutela jurídica se inspira en regulaciones regidas por el principio de territorialidad, mientras que la Red, universal y omnipresente, posibilita la explotación de derechos en un mismo instante en diferentes países, con diferentes regulaciones y niveles de protección, a nivel mundial, lo que requiere la implementación y desarrollo de normas de Derecho Internacional Privado robustas y flexibles. Ello sabido, decir que la presente obra —premio de monografías AISGE/REUS/ASEDA 2015— analiza minuciosamente las implicaciones jurídicas de la protección de la propiedad intelectual en Internet y, en particular, la responsabilidad de los PSSI —intermediarios— por los contenidos ilícitos alojados, así como la dimensión internacional —competencia judicial internacional y ley aplicable— que se suscitan en la explotación de derechos en la Red. Miguel Ortego Ruiz, su autor, es Licenciado en Derecho y Máster en Derecho Internacional por la Univer-sidad Complutense de Madrid. También es Licenciado en Administración y Dirección de Empresas por la Universidad Complutense de Madrid y ha realizado cursos en materia de Auditoría Interna, Estrategia empresarial, Tecnología y Propiedad Intelectual, Derecho Procesal y Derecho Europeo.
