Book excerpt: La responsabilidad de las empresas y de los administradores de sociedades frente a la Seguridad Social no está exenta de dificultad, por ser varias las materias sobre las que incide la declaración de responsabilidad añadida a la del sujeto directamente responsable, que da lugar a una ampliación de ámbito subjetivo de la responsabilidad en virtud de las reglas de la solidaridad o de la subsidiariedad contempladas principalmente en los artículos 42 del ET y 104 y 127 de la LGSS. Esta monografía analiza en profundidad los supuestos de responsabilidad de Seguridad Social que pueden producirse en los grupos de empresa, en las contratas, en el cambio de titularidad de la sociedad, en la cesión (lícita o no) de mano de obra, o en otros fenómenos interempresariales, así como la que puede afectar a los administradores de sociedades por incumplimiento de la normativa mercantil. Desde otra perspectiva, se estudia el procedimiento para la exigencia de la responsabilidad solidaria o subsidiaria, de conformidad con lo establecido en el Real Decreto 1415/2004, de 11 de junio, con incidencia en las deudas derivadas de la cotización y prestaciones, prestaciones indebidamente percibidas, sanciones administrativas, recargo de prestaciones, etc. En fin, el estudio de la responsabilidad empresarial por deudas de Seguridad Social concluye afrontando la espinosa cuestión de la intervención reconocida en la Ley General de la Seguridad Social a la Inspección de Trabajo para declarar la responsabilidad derivada en las deudas por cuotas, bien entendido que se trata de una competencia concurrente con la de la Tesorería General de la Seguridad Social.
