However, after 40 years of political neoliberalism, these justifications seem insufficient for achieving progress in the area of labour and employment rights. This book changes the narrative of why we need labour standards. It begins with a study of the reasons that gave rise to labour law in the context of the Industrial Revolution and its evolution, and moves on to analyse the current context dominated by globalisation and economic digitisation. It then proceeds to study the main justifications for intervention in the labour market in the current business-economic context on a global scale: economic growth; pre-distribution of wealth; a meritocratic allocation of working conditions and equality among workers. Using case studies and examples from across the EU, the UK, and the US, the book shows how the deregulation of labour markets harms innovation and the economy, especially when considering the challenges of platform work, algorithms, and AI. It demonstrates that labour standards such as the minimum wage, sectoral collective bargaining and collective rights, protection against dismissal and discrimination, occupational risk prevention, and social security are necessary for the economy to function properly.

It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. The book will be a valuable resource for academics and researchers working in the areas of labour law, social security law, legal theory and constitutional law.

Book excerpt: After contracting in 2009, GDP expanded by 5.9% in Latin America and the Caribbean in 2010, albeit with the region's hallmark differences in performance from one country to another. The expansion in output was driven by strong domestic demand in the forms of both consumption and investment, and by buoyant external demand. On the domestic demand side, private consumption (up 5.9%) was sustained by an upturn in employment and wages, brightening economic expectations, an expansion in lending to the private sector and, in some countries, an upswing in remittances from emigrant workers. Public consumption rose at a more modest rate of 3.9% and investment jumped by 14.5%, with strong growth in the machinery and equipment segments in particular. On the external demand side, exports of goods and services were especially buoyant -rising by over 10%- in the Southern Common Market (MERCOSUR) countries, the Dominican Republic, El Salvador, Mexico and Nicaragua. Meanwhile, imports of goods and services increased by more than 10% at constant prices on the back of robust domestic demand within the region, which rose 7.5%.
