Book Synopsis Rethinking Money Laundering & Financing of Terrorism in International Law by : Roberto Durrieu
Download or read book Rethinking Money Laundering & Financing of Terrorism in International Law written by Roberto Durrieu and published by Martinus Nijhoff Publishers. This book was released on 2013-05-16 with total page 506 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Rethinking Money Laundering & Financing of Terrorism in International Law: Towards a New Global Legal Order, Roberto Durrieu provides a broad and original analysis of the phenomenon of money laundering, through a thorough examination of the financing of terrorism. The necessity of excluding the financing of terrorism from the legal definition of money laundering is clearly illustrated through extensive, original and comparative research. In addition, the book advocates the recognition of money laundering as an international crime strictu sensu that can be tried by a special international tribunal. The hidden, mutable, complex and global nature of the crime must be addressed multilaterally through a new, integrated and more effective global legal order which is consistent and compatible with civil guarantees and human rights principles. Part I studies the main extra-legal and legal aspects of money laundering by analyzing the meaning, causes and effects of this phenomenon and their link with the financing of terrorism, with special attention to the interconnection between the so-called preventive/regulatory AML-CFT system and the punitive approach. Part II provides a global-comparative analysis to determine whether or not the adoption of money laundering offences is consistent with sound principles of criminal law and criminal procedure. Finally, Part III examines the jurisdictional problems with respect to extra-territorial and large-scale money laundering cases. The book offers nuanced and thought-provoking answers to questions regarding the prohibition of money laundering, the financing of terrorism, and the relationship between them, the current state of associated International Law, the need for future action, and the human rights consequences of these crimes.

Book excerpt: Shared Responsibility: U.S.-Mexico Policy Options for Confronting Organized Crime is a joint research project between the Woodrow Wilson Center's Mexico Institute and the University of San Diego's Trans-Border Institute. This publication examines specific challenges for security cooperation between the United States and Mexico including efforts to address the consumption of narcotics, money laundering, arms trafficking, intelligence sharing, policy strengthening, judicial reform, civil-military relations, and the protection of journalists. It concludes that binational efforts to stop organized crime and the exploding violence in Mexico have made positive advances but could fail to adequately address the challenge unless cooperation is significantly deepened and expanded.

Book Synopsis Global Perspectives on Migration and Development by : Irena Omelaniuk
Download or read book Global Perspectives on Migration and Development written by Irena Omelaniuk and published by Springer Science & Business Media. This book was released on 2012-05-23 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the first in a new Springer series to examine one of humanity’s most pressing concerns: global migration and its implications for development. As population mobility grows in an ever more crowded world, the Global Forum on Migration and Development (GFMD) has emerged as the most important global mechanism to deal with the urgent challenges it presents. This book explores fresh strategies proposed by the GFMD in its fourth year of operation in Mexico and beyond. Interrogating the relationship between migration and development, the papers advance the Global Forum’s aims of reducing poverty and empowering low-income families everywhere. In 2010, there were 214 million international migrants worldwide, nearly two and a half times the number in 1965. By 2050, international migration is likely to expand sharply in scale, reach and complexity, due to growing demographic disparities, environmental change, shifting global political and economic dynamics, technological innovations and social networks. Migration can bring substantial gains to families in less-developed countries, and mobile labor is an axiomatic feature of the global economy. Yet outward migration of skilled workers can seriously retard development at home, and exert pressure on wages in host nations. Balancing these and other conflicting concerns requires the substantive and expert discourse offered in this book. Contributors discuss, and propose concrete solutions to, vital issues such as the debilitating costs of cross-border labor recruitment and the provision of social and income protection for foreign contract workers. With suggestions on how to facilitate connections between transnational families, and gender- and family-sensitive immigration regimes, this book aims to foster collaborative intergovernmental links as well as partnerships between governments, civil society and international organizations. It shows how the GFMD can positively influence policy and institutional behavior while addressing wider systemic factors in protecting mobile workers.
