El estudio recoge la Convención de NNUU sobre los derechos de las personas con discapacidad de 13 diciembre 2006, ratificada por Instrumento de 23 noviembre 2007(BOE abril 2008) y su Protocolo Facultativo. Tanto el acceso a la Administración Pública como su provisión, constituyen actos relevantes para los aspirantes en un caso y para los empleados públicos en otro. La defensa de la transparencia administrativa en el acceso, así como la aplicación de los principios de igualdad, mérito, publicidad y capacidad en la segunda, fraguan la solidez de un Estado de Derecho. Pero también, en lo que refiere a la provisión de puestos, confluyen otros intereses loables de la organización pública, como son la buena llevanza del servicio y la potestad de autoorganización que obligan a adoptar medidas que afectan a los empleados. Estas decisiones deberán ejecutarse con sensibilidad para que la eficiencia gestora no se vea afectada.
