La thèse défendue est que la nouvelle Convention n'apporte finalement qu'une réponse partielle à la complexité de la question de la protection de la diversité culturelle dans le contexte de la mondialisation économique et du progrès technologique. Le nouvel instrument a l'objectif de donner officiellement à la culture un statut particulier dans l'ordre juridique international. Mais, compte tenu de son objet limité, la Convention de 2005 ne règle pas par elle-même l'ensemble de la question de la protection internationale de la diversité culturelle. Elle constitue en tout cas une avancée dans la construction d'un nouveau pilier de la gouvernance mondiale.
