Book excerpt: La finalidad de esta investigación es ofrecer un panorama de la regulación vigente en México respecto a la sustracción internacional de menores, para identificar de qué manera y hasta qué punto el Estado mexicano da respuesta a los problemas que se derivan de la aplicación de los instrumentos internacionales y la normativa autónoma, en esta materia. El análisis de este trabajo se realiza desde una perspectiva integral que contempla los sectores del DIPr: competencia judicial internacional, derecho aplicable, reconocimiento y ejecución de sentencias, así como cooperación internacional. En este sentido, hacemos alusión a algunos instrumentos intracomunitarios y a la legislación española. Sin embargo, al ser éste un estudio sobre DIPr. mexicano nuestra principal fuente es la normativa, autónoma y convencional, y la jurisprudencia mexicana. Comenzamos exponiendo algunos aspectos conceptuales necesarios para el entendimiento de este trabajo. Al ser la sustracción internacional de menores una figura compleja, profundizamos en el estudio de los contenidos, las implicaciones, las limitantes y la aplicabilidad de los distintos instrumentos jurídicos mexicanos que dan respuesta a este supuesto. El estudio de todos los elementos vinculados con la sustracción internacional de menores y su desarrollo en cada uno de los sectores del DIPr. son analizados desde dos perspectivas: cuando México es el país de destino del menor y cuando México es el Estado de origen y el de la residencia habitual de éste. Es así que respecto a la decisión de restitución o de su negación se consideran algunos aspectos que pueden impactar la resolución, tales como: la declaración de incompetencia por parte de los Tribunales de la residencia habitual del menor; la denegación del retorno sobre la base de que existió consentimiento para el traslado del menor; la decisión de no restitución a partir de que haya transcurrido más de un año desde la demanda de sustracción; la protección de los menores como acción de interés público; la discrecionalidad judicial en las excepciones para la denegación de la restitución, así como el análisis del criterio negativo de competencia. Asimismo, consideramos el entramado competencial y legislativo mexicano para la determinación de la competencia judicial internacional de los Tribunales mexicanos de las distintas Entidades Federativas que conforman la Unión, así como para la determinación del derecho aplicable al proceso y al fondo del asunto. Igualmente abordamos la cooperación internacional que se prestan las autoridades jurisdiccionales y administrativas de los Estados para lograr los objetivos de los convenios que regulan la restitución internacional de menores (Convenio de La Haya sobre los aspectos civiles de la sustracción internacional de menores y el Convenio Interamericano sobre restitución internacional de menores), así como el auxilio existente entre los órganos internos. Posteriormente, analizamos la postura y normativa de México como Estado requirente, es decir, las actuaciones judiciales y administrativas del Estado mexicano y su competencia judicial para conocer sobre el fondo, los conceptos de patria potestad, custodia y visita, así como las implicaciones que tendría la declaración de competencia por parte del Estado de la sustracción. Todo lo anterior es relevante para entender la expectativa jurídica de las autoridades mexicanas al solicitar la restitución de menores a México. Igualmente abordamos los controles y mecanismos que se deben cumplir para que el Estado mexicano reconozca y ejecute un pronunciamiento extranjero. Por último, reflexionamos acerca de la naturaleza jurídica pública y/o privada del derecho de familia en México, para darle un matiz de orden público e interés social a todo el contenido de esta investigación.
