Book excerpt: The process of demographic transition through which Argentina is passing is a window of both opportunities and challenges in economic and social terms. Argentina is still a young country in which the working-age population represents the largest proportion of its total population. Currently, the country just began a 30-year period with the most advantageous age structure of its population, which could favor greater economic growth. This situation, known as the 'demographic window of opportunity,' will last until the beginning of the 2040s. The dynamics of the fertility and mortality rates signify a gradual ageing of the population, with implications for various dimensions of the economy, the social protection system, public policies, and society in general. This book studies the opportunities and challenges that the demographic transition poses for the Argentine economy, its most important social sectors like the healthcare, education, and social protection systems, and the potential fiscal trade-offs that must be dealt with. The study shows that even though Argentina is moving through its demographic transition, it just recently began to enjoy the window of opportunity and this constitutes a great opportunity to achieve an accumulation of capital and future economic growth. Once the window of opportunity has passed, population ageing will have a significant impact on the level of expenditure, especially spending in the social protection system. This signifies a challenge from a fiscal policy point of view, because if long-term reforms are not undertaken to mediate these effects, the demographic transition will put pressure on the reallocation of fiscal resources among social sectors. Finally, population ageing poses concerns related to sustaining the rate of economic growth with a smaller working-age population. Taking advantage of the current window of opportunities, increasing savings that will finance the accumulation of capital, and increasing future labor force productivity in this way is a challenge for the Argentine economy.

Se ha pasado de un enfoque caracterizado por su particularismo o especificidad (dimensión sectorial), y centrado en la prohibición de discriminaciones y reconocimiento de cobertura social, a otro, en el que -de la mano de los derechos humanos- se asume una nueva concepción, integral, pasando de un modelo en el que se imponía la lógica aseguradora a una lógica integradora. El hito clave en este cambio de modelo se sitúa en la aprobación en 2006 de la Convención Internacional sobre los Derechos de las Personas con Discapacidad de las Naciones Unidas, en la que se abandona el modelo "paternalista", adoptando un modelo de igualdad plena en la diferencia. Importa hacer notar que la Unión Europea, como tal, firmó la Convención de las Naciones Unidas sobre los derechos de las personas con discapacidad en el día de apertura para su firma, el 30 de marzo de 2007 (IP/07/446). Es el primer tratado exhaustivo sobre derechos humanos ratificado por el conjunto de la Unión Europea.Con esta lógica, se articula un modelo social de la discapacidad, que inspira todo el estatus jurídico de una persona con diversidad funcional, y que exige que todo análisis puntual tenga como referente la dimensión integral e integradora. A ello responde esta obra, como su propio título declara: con pretensión de exhaustividad, hacer una compilación de todas las medidas que contribuyen a la protección jurídico-social de este colectivo, pero siempre con un enfoque integral. Ello nos lleva a extender el estudio más allá de las clásicas fronteras de lo laboral, de la Seguridad Social y de la Asistencia Social, incorporando análisis de los saberes propios de otras disciplinas, incluso no solo estrictamente jurídicas.Para ello, seguimos cuatro vectores, dos genéricos, y dos más ajustados a lo jurídico-social. Los primeros son la dignidad (punto de partida del reconocimiento de los derechos humanos de cualquier colectivo), la accesibilidad e igualdad de oportunidades en sentido amplio. Mientras que los segundos son su posición laboral (lo que lleva a políticas de empleo y régimen laboral) y su protección social pública (incluyendo los mecanismos que conforman ese concepto, que va más allá -aunque la integra de manera diferenciada- de la Seguridad Social en sentido técnico estricto).El equipo de investigadores necesario para acometer una obra de tal magnitud es muy amplio a la par que multidisciplinar, incorporando no solo iuslaboralistas (de las Universidades de Granada y de Málaga), sino también civilistas y fiscalistas, entre otros; además de profesionales que llevan años trabajando en el mundo de la discapacidad.Así, tras un planteamiento general sobre la conceptuación y modelos de atención a la discapacidad y el cambio de paradigma (analizando el marco regulador, nacional e internacional), dedicamos un bloque a todos los derechos que giran sobre la noción de "dignidad", lo cual lleva a visitar el derecho a la vida, a la personalidad, integridad, independencia e inclusión, la igualdad, privacidad, seguridad frente a abusos, acceso a la educación y libertades de expresión y de opinión.La accesibilidad e igualdad de oportunidades constituyen otro de los bloques clave para un abordaje integral de las necesidades de las personas con diversidad funcional. Dentro del mismo, se estudia la accesibilidad integral y no discriminación (movilidad, transporte y acceso a productos, servicios, información, medios de comunicación y tecnologías); accesibilidad en materia de urbanización, edificación y vivienda, participación en la vida política, pública y cultural; así como accesibilidad y garantía del derecho a la igualdad de oportunidades.Partiendo de esas nociones generales, la obra se adentra en el régimen jurídico-laboral de los trabajadores con discapacidad, tanto en la fase previa a su incorporación al mercado laboral, como las particularidades que puede presentar su relación laboral. Respecto de la primera fase, son analizadas exhaustivamente instituciones como las cuotas de reserva, el fomento del empleo por cuenta ajena y por cuenta propia, el programa de empleo con apoyo, los centros especiales de empleo así como los enclaves laborales. En cuanto a su estatuto jurídico como trabajador en activo, se repasan todas las particularidades existentes en la prestación de servicios y vicisitudes de la relación laboral, con especial atención a la controvertida y recientemente reformada extinción contractual por incapacidad sobrevenida.El apartado relativo a la protección social pública tiene un especial peso, como no podía ser de otra forma, incluyendo el estudio de los mecanismos protectores "clásicos" (previstos por el Sistema de Seguridad Social y la Asistencia Social), como los más novedosos como son los del Sistema de protección de las situaciones de Dependencia.Dentro de las "clásicas", no nos limitamos a las que de forma directa tienen como sujetos protegidos a personas con discapacidad (incapacidad permanente en sus diferentes grados y pensiones no contributivas), sino a aquéllas que modalizan la cobertura en caso de que la persona que sufre la contingencia además presente un grado de discapacidad (jubilación, por ejemplo), de modo que junto con las prestaciones específicas, se incluye el estudio de la cobertura jurídica a través de técnicas indiferenciadas que puedan recibir las personas con diversidad funcional. Junto a ello, de manera singular nos centramos en la protección recibida por colectivos cuya actividad profesional presentan particularidades, como son los funcionarios, militares y deportistas profesionales.El último bloque analiza los "externos" al Sistema de Seguridad Social, unos "novedosos" (como el Sistema de Dependencia), y otros con larga tradición (como los Servicios Sociales y las residuales prestaciones Sociales y Económicas de la Ley General de la Personas con Discapacidad). Y dentro de ellos, la destacada protección de la salud y atención integral a las personas con discapacidad.Cierra la publicación el estudio de tres materias con entidad propia: la prevención de riesgos laborales y discapacidad, la protección fiscal de la discapacidad, y la protección jurídico-civil de la discapacidad, con lo que se ofrece al lector una visión lo más amplia posible de la protección jurídica de la discapacidad en nuestro Ordenamiento Jurídico.Se viene a cubrir así, en gran medida, un sector de la vasta bibliografía existente sobre la Discapacidad stricto sensu, pues son escasas las obas que de un modo actualizado, exhaustivo y omnicomprensivo se dediquen al tratamiento de esta institución en su perspectiva jurídica y política, así como a valorar su alcance. Es por ello por lo que este libro, desde sus reflexiones analíticas, profundas y propositivas tiene la aspiración efectiva a convertirse en toda una obra de referencia teórica y práctica para los distintos sectores profesionales relacionados -o interesados en- con la misma.
