Se suele relacionar la Constitución de 1978, en cuanto a las características constitucionales que presenta con las de 1812, 1869 y 1931 –incluso defendiendo su influencia, no obstante el título III sigue a la Constitución de 1876–. En materia de protección de los consumidores y usuarios, los antecedentes nos los encontramos en la Constitución portuguesa de 25 de abril de 1976. No se ha constitucionalizado precepto alguno en defensa de los consumidores en las vigentes Constituciones de Italia de 22 de diciembre 1947, francesa de 4 de octubre de 1958 –ni siquiera después de la reforma constitucional introducida en 2003–, ni en la Ley Fundamental de Bonn de 23 de mayo de 1949. Sin embargo, Alemania sí fue pionera en limitar la autonomía de la libertad contractual iniciando las restricciones a la libertad de mercado desde el siglo XIX –así, por ejemplo, la Ley de 1894 sobre plazos en materia de préstamos en los que se establecen requisitos y límites a las cláusulas abusivas en los contrato de créditos para compra de bienes muebles–, aunque no fue hasta la década de los sesenta cuando se inició la protección legal de los consumidores y usuarios. La defensa de los consumidores ha tenido una gran evolución desde la entrada del Código Penal de 1995. El tipo de conflicto jurídico que suele ir aparejado a esta relación entre consumidor y ofertante de los servicios ha ido evolucionando desde su respuesta civil y la administrativa, en los casos en que la administración tiene que sancionar de terminadas conductas, a su entrada en el Código penal. Un tema aparentemente sencillo sería determinar qué rama del ordenamiento jurídico debe de intervenir para proteger los intereses de los consumidores. En principio las relaciones contractuales relativas al consumo no tendrían que tener mayor problema que las derivadas del Derecho contractual civil. Sin embargo, las nuevas formas de producción y de contratación en masa hacen inviable dicha posibilidad y es por ello que el Derecho administrativo y el Derecho penal entran de lleno en la protección del consumidor como sujeto pasivo abstracto que representa a una colectividad. Por tanto, los resultados que afecten directamente al patrimonio de un sujeto individual se protegerán con los delitos patrimoniales y, dado que afecta directamente al patrimonio, el Derecho administrativo no va a actuar...

They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing.
