Con il Regolamento UE n. 679/2016, (General Data Protection Regulation, GDPR) ed il d.lgs. n. 101/2018 di adeguamento della disciplina contenuta nel d.lgs. 30 giugno 2003, n. 196 al GDPR, gli interessati acquisiscono una serie di diritti sui propri dati a fronte dell'obbligo di ogni Ateneo di trattare i dati in base ai principi di liceità, correttezza, trasparenza, limitazione delle finalità, minimizzazione dei dati, esattezza, limitazione della conservazione, integrità, riservatezza e responsabilizzazione (accountability). Speciale attenzione viene riservata alla procedura di data breach, nonché alla ricerca medica, biomedica ed epidemiologica che prevede trattamenti di dati particolari la cui conoscibilità può incidere in maniera significativa sui diritti e le libertà degli interessati. L'università deve contemperare l'esigenza di tutela dei dati personali e della loro riservatezza, con il diritto di accesso agli stessi in funzione del principio di trasparenza, che si esercita oggi in tre modalità: accesso documentale (art. 22 Legge n. 241/1990), accesso civico semplice e accesso civico generalizzato (rispettivamente articolo 5, comma 1, e art. 5, commi 2 e 3 del d. lgs. n. 33/2013).

Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition.
