Cependant, son efficacité dépend surtout des règles de procédure pénale qui visent la découverte de la vérité. Or ces règles ont des bornes. Celles ci sont issues d'un conflit omniprésent entre les libertés individuelles et l'intérêt de la société à une sécurité maximale. Parvenir à un équilibre entre deux intérêts apparemment antagoniste rend toujours la preuve un sujet délicat. Cette complexité d'établir la preuve en matière pénale s'accroît considérablement en matière de criminalité organisée. Cette complexité est due tantôt à la menace conséquente de cette délinquance à nos sociétés, tantôt à ses caractéristiques. Après avoir fait apparaître ces difficultés, deux réactions peuvent être observées pour y faire face : soit adopter un arsenal juridique hors de commun qui peut se heurter fortement aux droits de l'homme, soit sacrifier les intérêts de la communauté au profit des libertés individuelles ce qui menace la stabilité et les valeurs d'un État de droit. L'objectif de cette étude est de faciliter la preuve en matière de criminalité organisée ; une lourde tâche d'autant plus qu'il s' agit de parvenir à une conciliation entre deux intérêts également puissants, également sacrés. Par conséquent, nous nous bornons à étudier le renversement de la charge de la preuve ainsi que quelques moyens de preuve dont surgissent des inquiétudes préoccupantes relatives à leur compatibilité avec les droits de l'homme, comme les opérations sous couverture et certaines méthodes scientifiques. Cette recherche dépend des expériences nationales, tout en essayant de dégager les solutions appropriées.

The reports were written for the XIVth Congress of the International Academy of Comparative Law which was held in 1994 in Athens, Greece. As narcotics trafficking exploded in the 1980s, it was realized that money laundering had become a threat to the entire integrity of the financial system. The international trend to regard money laundering as a serious threat to the stability of democracy and the rule of law found expression in the adoption of the 1988 United Nations Drugs Convention. Gradually, the international community diverged from its traditional, narrow approach whereby only the laundering of drug proceeds was considered a threat. In order to combat money laundering efficiently, it soon became clear that criminal law was not sufficient and that it was necessary for banks and other financial institutions to co-operate with law enforcement agencies. The banking community is now obliged to report suspicious transactions, which they often regard as going beyond their role as bankers. The issue of bank secrecy has played an important role in the discussion between law enforcement agencies and the banking community. Both the Council of Europe Convention on Laundering Search, Seizure and Confiscation of the Proceeds from Crime and the UN Drugs Convention require that bank secrecy should not be an obstacle to international co-operation. At the national level the seizure of bank records should not be hindered by bank secrecy.

It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely.
