Available in PDF, EPUB and Kindle. (Alemania); Universidad EAFIT, Medellín (Colombia); Queen Mary University, Londres (Reino Unido).

The study connects with the reflections that have been made for some years in global law studies, showing how this trend also has a clear manifestation in the field of criminal law. The analysis begins by mapping out the different manifestations of this new global criminal regulation. This includes very diverse areas, ranging from judicial cooperation to the problems involved in the application of criminal sanctions in failed states, or investigations carried out on the internet. New sanctioning systems are also studied, such as the debarment regime of the World Bank or the sanctions in the hands of international sports federations. It is a question of discovering all criminal law – understood in a broad sense – that lies outside the confines of the state.

Book excerpt: This book intends to contribute to the consolidation of the new approach to lawmaking that has taken place in the last 20 years in legal philosophy and legal theory, spreading to other legal fields, especially criminal law. This new legislation science focusing on criminal problems has triggered a growing interest in the field, a dynamic which has led to a long-needed convergence of disciplines such as administrative law, criminal law, criminology, political science, sociology and, of course, legal philosophy to contribute to a more rational decision-making process for the construct of criminal laws. With the intention to continue on with the building of a solid “Criminal Legislation Science”, this work presents scholars, lawmakers and students various emblematic approaches to enrich the discussion about different and promising tools and theoretical frameworks.

Book excerpt: This book presents the results of the latest in a long-running research project using the RIMES instrument, developed by scholars in Spain. Here, RIMES is used to measure the extent of social exclusion resulting from the penal system in comparative perspective. The volume shows the results of the application of the instrument in seven criminal justice systems: Germany, Italy, Spain, Poland, England and Wales, California, and New York. Divided into two parts, the first provides a general overview of the RIMES instrument, including a discussion of the theoretical model and the methodology. The second part focuses on the results of the application of RIMES in the seven jurisdictions. The comparative results are organised according to the nine dimensions included in the RIMES instrument: control of public spaces; legal safeguards; sentencing and sanctions systems; harshest penalties; prison rules; preventive intervention; legal and social status of offenders and ex-offenders; police and criminal records; and youth criminal justice. The last chapter summarizes the comparative results and ranks them in terms of the findings on social exclusion. The book will be of interest to academics, researchers and policy-makers working in the areas of Comparative Criminal Justice, Criminology, Criminal Law and Policy.

Book excerpt: Radicalization, Terrorism, and Conflict is a collection of scholarly works, authored by international researchers and leading thinkers, addressing contemporary, history-making issues in international security and terrorism from an interdisciplinary perspective. Contributors to this edited volume represent global perspectives, ideas, analysis, and research. Radicalization, Terrorism, and Conflict transmits relevant findings, theory, and policy ideas for scholars of security and terrorism studies, for policy makers, and to the general public who are interested in keeping up with this global area of concern. It provides a jumping-off point for conversation and collaboration that can lead to new knowledge and broader understanding. As an interdisciplinary collection of manuscripts, this book integrates and synthesizes theory, research, and public policy analysis in an effort to solve the complex questions and problems presented by this topic. Recognition of the need to approach the problems of radicalization, terrorism, and interpersonal conflict from an interdisciplinary perspective is gaining strength within academic settings, policy institutes, and global conferences. Unlike most recent edited books on the subject that are on the market at this time, Radicalization, Terrorism, and Conflict provides an interdisciplinary approach to understanding related current issues. This approach encourages a broader perspective and thought process, trans-discipline and global collaboration and cooperation, and an integrated synthesis of knowledge. Radicalization, Terrorism, and Conflict opens with an analysis of the ongoing phenomenon of the Arab Spring. In Section 1, contributors look at how players in the theatres of local and international terror become radicalized. Section 2 analyzes how terrorism becomes manifest in the global theatre and how governments and their actors attempt to prevent it. Section 3 presents research to bring understanding to the actors’ behavior and provide settings for future collaboration in understanding these phenomena.

Available in PDF, EPUB and Kindle. Book excerpt: The EU now possesses a clear legal basis for taking action on criminal law matters and steering the policy and practice of Member States in relation to crime and criminal law. However, for what is now an important area of law, there remains a striking absence or uncertainty regarding its theoretical basis, its legitimacy and its conceptual vocabulary. This book offers a review of the significance of EU criminal law and crime policy as a rapidly emerging phenomenon in European law and governance. Bringing together an international set of contributors, the book questions the nature, role and objectives of such 'criminal law', its relationship with other areas of EU policy and law, and the established rules of criminal law and criminal justice at the Member State level. Taking up such subjects as the application of criminal law across national boundaries and in the broader European context, effective enforcement, and the working out of a new European policy, the book helps to structure an increasingly significant subject in law which is still finding its direction. The book will be of great use and interest to researchers and students of EU law, criminal justice, and criminology.

Book excerpt: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States, two ‘new’ members, a candidate country, and three non-EU countries. Based on a standardised research protocol, thirty-three experts from different legal and social disciplines provide insight through detailed country reports. On this basis, the editors compare organised crime patterns and policies in Europe and assess EU initiatives against organised crime.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers a critical analysis of hate crime law using Italy as a case study. Employing a multidisciplinary approach, it develops an international framework for mapping hate crime laws onto the phenomenon of hate crime itself, allowing for better legislation to be drafted. It shows how this analytical tool may be used in practice by applying it to legislation in Italy, where Parliament recently dismissed a legislative proposal to extend hate crime law to sex, gender, sexual orientation, gender identity, and disability. The framework allows readers to critique the rationale behind hate crime laws and the effect of, or potential effect of, their implementation. This book ultimately seeks to answer to the question of how and whether States can legitimately introduce a harsher sentence for bias motivated crimes. It bridges interdisciplinary hate studies and more traditional legal analysis. It speaks to an international audience as well as to an audience with a specific interest in the Italian context.
