Book excerpt: Les Pays et Territoires d'Outre-Mer (PTOM) ont été au cœur de discussions épineuses au début de la réalisation du Marché commun. Devant cette difficulté, la formule de l'association est apparue comme une solution adaptée à la situation particulière de ces territoires ultra-marins. Il convenait, en effet, pour les pères fondateurs, d'intégrer les PTOM dans le Marché commun à travers un régime spécial d'association, lequel leur octroie des avantages commerciaux asymétriques dont l'objectif est de répondre à leurs spécificités. La spécificité de ces territoires relevant de la souveraineté de la France, du Danemark, des Pays-Bas et du Royaume-Uni, résultant en réalité d'une application partielle du traité, a été à l'origine d'une détermination très brouillée de leur place au sein même de l'Union. Ainsi, les PTOM sont-ils exclus du champ d'application territorial du droit de l'Union, en leur qualité de territoires non européens entretenant des relations particulières avec un État membre. Paradoxalement ils demeurent inclus dans le champ d'application personnel du droit de l'Union, puisque leurs ressortissants, au-delà de quelques nuances, jouissent du statut de la citoyenneté de l'Union. Ils héritent donc d'une situation ambivalente marquée par une intégration différenciée, voire spécifique, mais aussi par une assimilation de fait à des pays tiers. La situation des PTOM sur le plan de l'Union peut donc être résumée (ou représentée) d'une manière caricaturale avec les mots du Professeur Jacques Ziller, comme ayant « un pied dedans et un pied dehors ». Dès lors, la détermination de la place des PTOM dans la politique de l'Union invite, à l'aide d'une approche institutionnelle et constitutionnelle, à déterminer quel est l'aspect dominant, entre intégration et assimilation à des pays tiers. C'est dans cette perspective que s'inscrit la présente étude.

These people, like the companies registered in such territories, often find it virtually impossible to determine what law applies when legal decisions are required. Although Article 52(1) of the EU Treaty clearly states that EU law applies in the territory of all the Member States, most Member State territories lying outside of Europe provide examples of legal arrangements deviating from this rule. This book, for the first time in English, gathers these deviations into a complex system of rules that the editor calls the 'EU law of the Overseas'. Member States' territories lying far away from the European continent either do not fall within the scope of EU law entirely, or are subject to EU law with serious derogations. A huge gap thus exists between the application of EU law in Europe and in the overseas parts of the Member States, which has not been explored in the English language literature until now. This collection of essays sets out to correct this by examining the principles of Union law applicable to such territories, placing them in the general context of the development of European integration. Among the key legal issues discussed are the following: internal market outside of Europe; the protection of minority cultures; EU citizenship in the overseas countries and territories of the EU; Article 349 TFEU as a source of derogations; The implications of Part IV TFEU for the overseas acquis; participatory methods of reappraisal of the relationship between the EU and the overseas; implications for the formation of strategic alliances; voting in European elections; what matters may be referred by courts and tribunals in overseas countries and territories; application of the acquis to the parts of the Member States not controlled by the government or excluded from ratione loci of EU law; interplay of the Treaty provisions and secondary legislation in the overseas; customs union; wholly internal situations; free movement of capital and direct investments in companies; the euro area outside of Europe; duty of loyal cooperation in the domain of EU external action; territorial application of EU criminal law; and territorial application of human rights treaties. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.
