Par ailleurs, il est incontestable que, après l'abolition de l'esclavage, la peine de mort demeure la question morale la plus controversée et l'insigne d'un clivage culturel tenace présentant des aspects philosophiques, psychologiques et anthropologiques. Dès lors, le problème de la peine de mort est peut-être le mieux à même de polariser les énergies des spécialistes - européens et américains - en droit pénal, en histoire du droit, en droit comparé, en droits fondamentaux et en philosophie du droit, mais aussi des philosophes, des anthropologues et des psychanalystes. Tel a été le dessein des XXIIIes Journées de l'Institut de Criminologie de Paris, qui ont eu lieu en avril 1998 et dont les actes sont publiés dans le présent ouvrage. Ce livre contient des contributions aussi variées que le rôle des procureurs et l'impact des processus de délibération judiciaire sur l'imposition de la peine capitale aux Etats-Unis, ou encore l'aspect sacrificiel de la mise à mort dans les sociétés anciennes, l'évolution du droit pénal français au Moyen Age et à l'époque des Lumières et l'influence de la notion de dignité humaine. Il s'adresse à la fois à un public plus averti et à des lecteurs non-spécialistes qui veulent faire le point sur la question.

In the past, various idiosyncrasies in the Greek translation of laws that involve the death penalty had been glossed over and considered stylistic variations or grammatical outliers. However, when the text-linguistic features of the Greek translation are compared to contemporary literary, documentary, and legal Greek sources, new readings emerge: cursing a parent is no longer punishable by death; a law about bestiality becomes a law about animal husbandry; the authority of certain legal commands is deregulated. This work explores these and other new readings in comparison with contemporary Greco-Egyptian law.
