El libro realiza planteamientos en torno a la parte estática del derecho administrativo, entendida como aquella que se concentra en la organización y estructura de la administración. En el caso de la organización administrativa ambiental requiere de soluciones heterogéneas para la complejidad de los conflictos que aborda donde existe una concurrencia y convergencia de competencias administrativas. El derecho de organización adquiere relevancia para dirigir y programar las funciones atribuidas a la Administración. El presente libro tiene una estructura sencilla, compuesta por cuatro partes. En primer lugar, una mirada rápida a la organización administrativa del Estado colombiano, haciendo un especial énfasis en el sector ambiental (que es el sector que nos ocupa en este trabajo), durante el periodo comprendido entre 1954 a 2018. En segundo lugar, las bases constitucionales en relación con la estructura administrativa ambiental, es decir, las normas de organización fundamental. En tercer lugar, algunas ideas en torno a los modelos de organización administrativa en el sector de referencia, los cuales son esenciales para el estudio de la estructura administrativa (parte estática del derecho administrativo). En cuarto lugar, el libro desarrolla un análisis a profundidad de los órganos que conforman la organización administrativa ambiental, es decir, las entidades que conforman el SINA, para ello la obra se concentra en las tres tareas centrales del derecho de organización: distribución orgánica, actividades y competencias. Por tanto, la mirada se dirige a la realidad administrativa, tanto en el nivel central como en el nivel descentralizado (por servicios y territorialmente) con el análisis riguroso de normas de organización administrativa primarias (legales) y secundarias (reglamentarias y administrativas). De esta manera, se reconoce la relevancia de hacer una evaluación al Sistema Nacional Ambiental (SINA) después de 30 años de la expedición de la Ley 99 de 1993 y fieles a la tradición de la academia jurídica ambiental del Departamento de Derecho del Medio Ambiente y su Grupo de Investigación. Este libro contribuye al ejercicio académico de hacer una revisión de la ley general del medio ambiente en lo atinente a la organización administrativa, y a la identificación de asuntos y oportunidades de mejora e innovación jurídica que doten de eficacia administrativa a las entidades que conforman el SINA y a los sectores regulados.
