Il est donc nécessaire d'établir une convergence de ces politiques. Dans un premier temps, la politique de la concurrence sera envisagée sous la forme d'une coopération bilatérale entre les diverses régions, notamment entre l'UE et les USA. Or, il s'avère que ces accords bilatéraux sont inefficaces, particulièrement lorsque l'enjeu est important (voir l'affaire Boeing). Dans un deuxième temps, l'auteur s'efforce de créer et de mettre en œuvre une structure plurilatérale dont le but serait de 1) contrôler et de 2) sanctionner les pratiques anticoncurrentielles à l'échelle mondiale. Ceci grâce à une coopération étroite entre les autorités de surveillance des pays concernés et un système efficace de règles, et de règlements des différends, devant une instance internationale indépendante, dont les décisions auraient une force contraignante. Cet ouvrage s'inspire entre autres de codes de concurrence réalisés par l'ONU et du Groupe de Munich. A l'heure actuelle l'OMC n'a toujours pas adopté de code comportant des clauses visant les pratiques anticoncurrentielles. Le nouvel ordre international a donc amené l'auteur à aller plus loin et à créer, pour la première fois, un code international de concurrence complet.

Les politiques de concurrence analysées dans le cadre de ce mémoire portent sur la période allant de 1985 a 1996. Dans un premier temps, la politique de la concurrence sera envisagée sous la forme d'une coopération bilatérale entre les diverses régions, notamment entre l'UE et les Etats-Unis, ce qui n'exclut pas parfois une certaine harmonisation entre les législations. Le principe de la convergence des lois de concurrence des Etats-Unis et de l'UE est lié au principe de la convergence des lois de concurrence de l'UE et des pays PECO. Bien que les règlements et les pratiques adoptés par les pays PECO,dans le domaine de la concurrence, soient fondés tant sur les "acquis communautaires" que les lois et les pratiques des Etats-Unis, leur harmonisation avec ceux de l'UE se fait de façon harmonieuse. En imitant ce processus d'harmonisation, on peut imaginer que l'UE et Etats-Unis seront également en mesure d'aller plus loin dans le rapprochement de leurs politiques de concurrence. Dans un deuxième temps, nous nous efforcerons d'analyser la faisabilité de créer et de mettre en oeuvre une structure plurilatérale. Celle-ci serait une première organisation ayant pour but de poursuivre des pratiques anticoncurrentielles à l'échelle mondiale, grâce à une coopération étroite entre les autorités de surveillance des pays concernés et à un système efficace de règles, de règlements des différends, y compris une procédure de dernier recours devant une instance internationale, dont les décisions devraient avoir une force contraignante sur les parties concernées. Cette thèse s'inspire d'autres travaux qui s'efforcent de donner les orientations sur des " dispositions types " qui pourraient faire partie d'un code type de concurrence dans un accord plurilatéral entre plusieurs pays, tels que ceux de l'ONU et du groupe de Munich. Nous nous efforcerons d'aller plus loin dans la démarche et de réunir les meilleurs éléments de ces codes, tout en ajoutant de nouvelles dispositions aboutissant a la création d'un code international en matière de concurrence.

L'objet de l'étude consiste à déterminer si la C.E. dispose d'instruments juridiques suffisamment efficaces et appropriés pour faire face à cette épreuve et relever ce défi.Les limites de la dimension extraterritoriale de la politique communautaire de concurrence, ont conduit la C.E. à renforcer sa coopération avec les autorités de la concurrence des pays tiers afin de garantir une meilleure protection du marché intérieur. Le caractère territorial du droit communautaire de la concurrence a conduit la C.E. à développer des instruments innovants afin de mettre sa politique dans ce domaine au service de l'accès aux marchés tiers.

The book proposes a robust, incisive alternative definition of politics: the mobilization of values to change or reproduce the institutions that orientate, and indeed make possible, economic activity. Drawing upon constructivist strands of institutionalism, political sociology, and industrial economics, this definition generates an analytical framework for understanding the 'political work' that constantly orientates the behaviour of both firms and public authorities. Specifically, a fundamental tension between the values of freedom and security is consistently examined. This is analysed by looking at conflicts within the definition of these two values, but also by examination of mobilizations of two subordinate values: equality and tradition. A hypothesis examined throughout the book's empirical chapters is that equality and tradition play either supporting, intervening, or silent roles within the freedom-security relationship that structures contemporary capitalism. Structured around controversies concerning the politics of economic activity at the global, European, national and local scales, the book examines the pharmaceutical, wine, local food, and car industries, as well as cross-cutting policies concerning issues such as regulating labour markets and inter-firm competition, geographical indications, and local economic development. Overall, the book's aim is to advocate a mode of thinking and research which challenges orthodox and dominant approaches to economics and its politics. It does so by placing a politics that is comprehensible, and therefore both 'studyable' and 'actionable', back at the centre of reflection about the economic and the political.
