Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.

This book was released on 2017-06-01 with total page 1806 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. Part One contains information on ratifications and other such issues in the authentic English and French texts. Part Two has details in English and French of the membership and activities of the Convention. Part Three reprints the twentieth annual General Report of the ECPT in the official English and French texts. Part Four contains the ECPT's reports to States and the State responses thereto that were made public during the year in question. The ECPT's reports are published in the official English and/or French texts and State responses in the English and/or French versions submitted by the States concerned. Bilingual English and French; two-volume set.

Book excerpt: Frequently characterised as either mercenaries in modern guise or the market's response to a security vacuum, private military companies are commercial firms offering military services ranging from combat and military training and advice to logistical support, and which play an increasingly important role in armed conflicts, UN peace operations, and providing security in unstable states.Executive Outcomes turned around an orphaned conflict in Sierra Leone in the mid-1990s; Military Professional Resources Incorporated (MPRI) was instrumental in shifting the balance of power in the Balkans, enabling the Croatian military to defeat Serb forces and clear the way for the Dayton negotiations; in Iraq, estimates of the number of private contractors on the ground are in the tens of thousands. As they assume more responsibilities in conflict and post-conflict settings, their growing significance raises fundamental questions about their nature, their role in different regions and contexts, and their regulation. From Mercenaries to Market examines these issues with a focus on governance, in particular the interaction between regulation and market forces. It analyses the current legal framework and the needs and possibilities for regulation in the years ahead. The book as a whole is organised around four sets of questions, which are reflected in the four parts of the book. Why and how is regulation of PMCs now a challenging issue? How have problems leading to a call for regulation manifested in different regions and contexts? What regulatory norms and institutions currently exist and how effective are they? What role has the market to play in regulation?

Available in PDF, EPUB and Kindle. Book excerpt: The classic and groundbreaking study of penal slavery throughout the ages is available again. Previously a rare book, despite the fact that it is widely quoted and cited by scholars in the field of sociology, penology, and criminology, this book can now be accessed easily worldwide and be assigned again to classes. Now in its fortieth anniversary edition, Sellin's classic Slavery and the Penal System adds a new Foreword by Barry Krisberg at Berkeley. This edition also incorporates changes the author originally planned for a second printing, provided to Quid Pro Books by the Library Special Collections at Penn and authorized by his family. Part of the Classics of Law & Society Series from Quid Pro Books, the anniversary edition also includes explanatory Notes of the Series Editor by Steven Alan Childress, senior professor of law at Tulane University. A book that has become a standard part of the canon in its field, but over time grew to be too expensive for researchers and libraries to obtain, is now easily downloaded in a well-formatted ebook. Other features include linked Contents and notes, fully linked and paginated Index, and close reading of the text against the original so that its legacy is properly and accurately presented. This book traces the direct and indirect influences of the social institution of chattel slavery on the evolution of penal systems and practices in Europe and the United States — a dismal story. The author reveals the darkest and most brutal aspects of penal history and the social forces that resisted or nullified the efforts of reformers who sought to bring about humanization of the punishment. The book shows that domestic punishments inflicted on slaves by masters later become legal punishments for crimes committed by low-class freedmen — eventually to become legal sanctions against offenders regardless of social status. A dominant force is the class and caste structure of society that is reflected in the determination of what conduct should be defined as criminal, who should be punished, and what the punishment should be. Topics include ancient Greece and Rome, the Middle Ages in Europe, galley slaves and naval arsenal prisons in maritime countries, penal creation of public works, the rise of houses of correction, invention of the treadmill, practices in England and Russia, slavery in the antebellum South, and twentieth-century U.S. chain gangs, penal farms, and convict-lease system.

Book excerpt: Young people are transforming the global landscape. As the human population today is younger and more urban than ever before, prospects for achieving adulthood dwindle while urban migration soars. Devastated by genocide, hailed as a spectacular success, and critiqued for its human rights record, the Central African nation of Rwanda provides a compelling setting for grasping new challenges to the world's youth. Spotlighting failed masculinity, urban desperation, and forceful governance, Marc Sommers tells the dramatic story of young Rwandans who are “stuck,” striving against near-impossible odds to become adults. In Rwandan culture, female youth must wait, often in vain, for male youth to build a house before they can marry. Only then can male and female youth gain acceptance as adults. However, Rwanda's severe housing crisis means that most male youth are on a treadmill toward failure, unable to build their house yet having no choice but to try. What follows is too often tragic. Rural youth face a future as failed adults, while many who migrate to the capital fail to secure a stable life and turn fatalistic about contracting HIV/AIDS. Featuring insightful interviews with youth, adults, and government officials, Stuck tells the story of an ambitious, controlling government trying to govern an exceptionally young and poor population in a densely populated and rapidly urbanizing country. This pioneering book sheds new light on the struggle to come of age and suggests new pathways toward the attainment of security, development, and coexistence in Africa and beyond. Book excerpt: This insightful volume examines key research questions concerning police decision to arrest as well as police-led diversion. The authors critically evaluate the tentative answers that empirical evidence provides to those questions, and suggest areas for future inquiry. Nearly seven decades of empirical study have provided extensive knowledge regarding police use of arrest. However, this research highlights important gaps in our understanding of factors that shape police decision-making and what is required to alter current police practice. Reviewing this research base, this brief takes stock of what is known empirically about all aspects related to the use of arrests, providing important insights on the knowledge needed to make evidence-based policy decisions moving forward. With the potential to better impact policy and programs for alternatives to arrest, this brief will appeal to researchers and practitioners in evidence-based policing and police decision-making, as well as those interested in alternatives to arrest and related fields such as public policy.

Available in PDF, EPUB and Kindle. Book excerpt: E. B. Pashukanis was the most significant contemporary to develop a fresh, new Marxist perspective in post-revolutionary Russia. In 1924 he wrote what is probably his most influential work, The General Theory of Law and Marxism. In the second edition, 1926, he stated that this work was not to be seen as a final product but more for ""self-clarification"" in hopes of adding ""stimulus and material for further discussion."" A third edition was printed in 1927.Pashukanis's ""commodity-exchange"" theory of law spearheaded a perspective that traced the form of law, not to class interests, but to capital logic itself. Until his death, he continued to argue for the ideal of the withering away of the state, law, and the juridic subject. He eventually arrived at a position contrary to Stalin's who, at that time, was attempting to consolidate and strengthen the state apparatus under the name of the dictatorship of the proletariat. Inevitably, Pashukanis was branded an enemy of the revolution in January 1937. His works were subsequently removed from soviet libraries. In 1954, Pashukanis was ""rehabilitated"" by the Soviets and restored to an acceptable position in the historical development of marxist law.In Europe and North America, a number of legal theorists only rediscovered Pashukanis's work in the late 1970s. They subjected it to careful critical analysis, and realized that he offered an alternative to the traditional Marxist interpretations, which saw law simply and purely as tied to class interests of domination. By the mid-1980s the instrumental Marxist perspective in vogue in Marxist sociology, criminology, politics, and economics gave way, to a significant extent due to Pashukanis's insights, to a more structural Marxist accounting of the relationship of law to economics and other social spheres. In his new introduction, Dragan Milovanovic discusses the life of Pashukanis, Marx and the commodity-exchange theory of law, and the historical lessons of Pashukanis's work.
