Ce principe est mis à mal par le droit à l'information, ou plus justement par l'usage fait de ce droit. Le droit à l'information, dans le procès pénal, légitime la présence de l'opinion publique et sa revendication d'une justice transparente. Or, la justice ne peut-être le forum des émotions sociales, comme elle ne saurait être le bras armé de l'opinion publique. En outre, l'excès de transparence nuit au bon fonctionnement des institutions judiciaires, comme l'excès de silence, légalisé par la loi du 15 juin 2000. La présence des médias dans le procès pénal ne peut être occultée dans un Etat démocratique, même si la conciliation des deux corps et des intérêts qui les animent, semble difficile. En effet, face à cet habitus judiciaire, qui se révèle par la forme et le lieu où est rendue la justice, le corps médiatique est dépourvu : ni lieu, ni construction empirique. C'est le monde du silence, de la réflexion contre le monde de la diffusion rapide de l'information et de l'absence de réflexion. Or, l'acte de juger demande le temps de la réflexion, la structuration de la pensée. L'élaboration d'un cadre juridique de l'activité médiatique s'impose pour garantir la présomption d'innocence, dont le concept "d'innocence" est controversé par l'opinion publique pour les infractions politico-financières. A l'instar de l'inculpation, devenue mise en examen, la présomption d'innocence doit être redéfinie. La protection effective de la "présomption de probité" des élus met en œuvre une procédure particulière de renforcement des responsabilités des magistrats et des médias, tendant à l'accroissement des responsabilités des acteurs désignés. Cela conduit à rappeler la mission de service public de la justice, devenu un service privé pour l'opinion publique, le rôle social des médias et les intérêts économiques en jeu.
