L'opposition citée se vérifie dans deux cas, analysés au regard du droit européen et du droit andin. Premièrement, le cas du titulaire unique qui renvoie à l'analyse de la limitation, imposé par le droit communautaire, à l'exercice des droits de propriété intellectuelle susceptibles de créer des restrictions injustifiées à la libre circulation des marchandises. Cette limitation s'effectue par l'application de l'épuisement du droit. Deuxièmement, le cas des titulaires distincts. Ce cas concerne, dans le domaine du droit des marques, la limite imposé par le droit territorial audit principe afin de préserver les droits indépendants instaurés conformément aux lois internes des Pays membres. Cette limitation s'effectue par l'application du principe de non-coexistence.

La thèse essaie d'analyser la recherche des règles d'une coexistence "pacifique" entre la logique communautaire et le mécanisme de protection des droits de l'homme de la propriété intellectuelle. Au-delà du droit, la question de la protection des droits pose un véritable problème économique. En effet, à un moment où on s'oriente vers un droit de la globalisation, la nécessité d'une protection communautaire harmonisée s'impose, mais pose par ailleurs l'opportunité d'une protection au niveau international.
