El capítulo quinto esta dedicado de forma exhaustiva al análisis de la libertad de enseñanza en la ley general de educación: democratización y socialización de la enseñanza libertad de creación y funcionamiento de centros no estatales naturaleza jurídica de la autorización la educación como servicio publico. El capitulo sexto estudia la libertad de educar en la ley general de educación = libertad de cátedra libertad de métodos y medios educativos y libertad de participación.
