Book Synopsis Gender Justice and Legal Pluralities by : Rachel Sieder
Download or read book Gender Justice and Legal Pluralities written by Rachel Sieder and published by Routledge. This book was released on 2013-06-17 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: Gender Justice and Legal Pluralities: Latin American and African Perspectives examines the relationship between legal pluralities and the prospects for greater gender justice in developing countries. Rather than asking whether legal pluralities are ‘good’ or ‘bad’ for women, the starting point of this volume is that legal pluralities are a social fact. Adopting a more anthropological approach to the issues of gender justice and women’s rights, it analyzes how gendered rights claims are made and responded to within a range of different cultural, social, economic and political contexts. By examining the different ways in which legal norms, instruments and discourses are being used to challenge or reinforce gendered forms of exclusion, contributing authors generate new knowledge about the dynamics at play between the contemporary contexts of legal pluralities and the struggles for gender justice. Any consideration of this relationship must, it is concluded, be located within a broader, historically informed analysis of regimes of governance.

Book Synopsis The Impact of Human Rights Prosecutions by : Ulrike Capdepón
Download or read book The Impact of Human Rights Prosecutions written by Ulrike Capdepón and published by Leuven University Press. This book was released on 2020-11-16 with total page 247 pages. Available in PDF, EPUB and Kindle. Book excerpt: New perspectives on human rights prosecutions in various regional contexts Human rights prosecutions are the most prominent mechanisms that victims demand to obtain accountability. Dealing with a legacy of gross human rights violations presents opportunities to enhance the right to justice and promote a more equal application of criminal law, a fundamental condition for a more substantive democracy in societies. This book seeks to analyse the impact, advances, and difficulties of prosecuting perpetrators of mass atrocities at national and international levels. What role does criminal justice play in redressing victims’ wrongs, guaranteeing the non-repetition of mass atrocities, and attempting to overcome the damage caused by systematic human rights violations? This volume addresses critical issues in the field of human rights prosecution by drawing on the experiences of a variety of post-conflict and authoritarian countries covering three world regions. Contributing authors cover prosecutions in post-Nazi Germany, post-Communist Romania, and transnational legal complaints by victims of the Franco dictatorship, as well as domestic and third-country prosecutions for human rights violations in the pioneering South American countries of Argentina, Chile, Peru, and Uruguay, prosecutions in Darfur and Kenya, and the work of the International Criminal Court. The Impact of Human Rights Prosecutions offers insights into the difficulties human rights trials face in different contexts and regions, and also illustrates the development of these legal procedures over time. The volume will be of interest to human rights scholars as well as legal practitioners, participants, justice system actors, and policy makers.

Download or read book Law in Conflict written by Angela Lindt and published by transcript Verlag. This book was released on 2023-12-31 with total page 261 pages. Available in PDF, EPUB and Kindle. Book excerpt: Peru's industrial mining sector is highly conflictual and characterized by social disputes. Many of these conflicts are fought not only in politics but also in the courts, as activists attempt to hold corporate and state actors liable for human rights violations. At the same time, they face an increasing criminalization of their protests. Law is thus both an emancipatory tool for activists to access justice and an instrument for political and economic elites to prevent social change. Based on ethnographic field work, Angela Lindt sheds light on various mining disputes in Cajamarca and Piura and examines the role of law in resolving these conflicts.
