Telle qu'elle se présente, la justice pénale se caractérise par un renversement des perspectives par rapport au droit commun. En ce sens, le mineur reconnu coupable d'infraction n'est justiciable que des juridictions spéciales. Mais, cela ne signifie pas que le législateur ivoirien et son homologue français ont légiféré très exactement de la même façon en matière de droit pénal des mineurs. Si en France, les réformes de la législation relative à la minorité ont permis une amélioration du statut de l'enfant délinquant et un renouvellement significatif des réponses à la délinquance des jeunes, il n'en va pas de même en Côte d'Ivoire. Aucune réforme n'a été enregistrée depuis 1981. Ainsi, les juridictions sont-elles réduites à se contenter de quelques dispositions du code pénal et du code de procédure pénale ().
