This period of far-reaching social and political upheaval in France began in 1789 with the fall of the Bastille and held the country in turbulence for the next decade. The Revolution overthrew the monarchy, established a republic, catalyzed violent periods of political turmoil, and finally culminated in a dictatorship under Napoleon. Conceived by Taine with the aim of understanding the France of his day, his work achieved originality in its use of a long perspective to analyze the causes of the French Revolution. In particular, Taine denounced the artificiality of the revolution's political constructions (the excessively abstract and rational spirit of Robespierre, for example), which, in his mind, violently contradicted the natural and slow growth of the institutions of a State. For him, the force of history is such that it is illusory to want to change a society. Thus, following the defeat of Sedan and the Commune, Taine accuses the French Revolution of being the matrix of all evils which brought France into a cycle of decadence. It is in particular the abstraction of the philosophy of the Enlightenment which is rejected.

Following the vein of French historiography, many twentieth-century scholars of the French Revolution believed that the middle class of lawyers played a crucial role in the Revolution. In The Barristers of Toulouse, Lenard Berlanstein contends with that notion in a case study examining the response of the Toulousian legal community to the French Revolution. Using tax rolls, marriage contracts, and court records as primary sources, Professor Berlanstein argues that class interests—such as a desire to preserve their status in the cultured, conservative urban elite—led many Toulousian judges and lawyers to reject the Revolution and to remain loyal to the aristocratic Parlement. In other words, those in the legal community of Toulouse conducted themselves in ways that were consistent with other members of their social and economic class. To supplement his argument, Berlanstein's integrates methods from the New Social History movement.

In Balancing the Scales of Justice, Anthony Crubaugh tests this claim by examining the effects of revolutionary changes in local justice on the inhabitants of one region in rural France. Crubaugh illuminates two poorly understood institutions in eighteenth-century France: seigneurial justice and the revolutionary justice of the peace. He finds that justice was typically slow and expensive in the lords&’ courts, thus making it difficult for rural inhabitants to benefit from official channels of justice. By contrast, revolutionary reforms gave people the opportunity to submit quarrels to trusted and elected justices of the peace who adjudicated disputes quickly and inexpensively. By juxtaposing seigneurial justice in the ancien r&égime with the institution of the justice of the peace after 1789, Crubaugh highlights how revolutionary changes in the system of dispute resolution profoundly affected members of rural French society and their relations with the French state. Over time rural dwellers came to accept the primacy of the state in resolving disputes, and the state thereby partially achieved its long-standing goal of penetrating rural areas.

Beyond an uneven course in different countries, Philosophy of Nonviolence examines how 2011 may have ushered in a fundamental break in world history. Part Three--Justice, covers the broadening concept of dictatorship as crime against humanity, an essential part of the philosophy of nonviolence. It follows its frustrated emergence in the French revolution, its development in the Middle East since 1860 through the trials of Arab dictators, the pyramid of accountability post-dictatorship, and the scope of foreign intervention in nonviolent revolutions. In this period the development occurred that the so-called system of legal proofs was replaced with the (largely) free evaluation of the evidence. The system of legal proofs, which had functioned since the late middle ages, consisted of a set of strict evidentiary rules which predetermined when a judge could convict someone. In this book an explanation is given of the question why between 1750 and 1870 the strict evidentiary rules were replaced with the free evaluation of the evidence. The thesis of this research is that the reform was induced by a change in the underlying epistemological and political-constitutional discourses which together provided the ideas which inspired a significant reform of the criminal law of evidence.
