Book excerpt: Actualmente, los participantes del transporte marítimo deben adoptar e implementar una serie de medidas de protección marítima para suprimir y combatir la piratería, el narcotráfico y el terrorismo marítimo. La presente investigación analiza los programas multilaterales y unilaterales de protección marítima, que deben cumplir los participantes del transporte marítimo internacional. El capítulo I menciona las diferencias entre la seguridad marítima y la protección marítima. Asimismo, este capítulo desarrolla las competencias de los Estados para combatir las amenazas a la protección marítima en los distintos espacios marinos. Los capítulos II, III y IV describen la problemática de la piratería, del terrorismo y del narcotráfico marítimo, respectivamente. Asimismo, los capítulos antes mencionados estudian el marco normativo internacional para suprimir y combatir las amenazas a la protección marítima. El capítulo V describe las incidencias de las amenazas a la protección marítima en los contratos de transporte y seguro marítima. En concreto, el capítulo antedicho detalla los cambios y las modificaciones que han sufrido los distintos formatos de los contratos de transporte y del seguro marítimo, para especificar las responsabilidades y obligaciones de cada una de las partes del contrato, que surgen como consecuencia de un acto de piratería, de terrorismo o de narcotráfico. El capítulo VI clasifica a los programas de protección marítima, con base en los elementos comunes de los mismos. El capítulo VII analiza los programas multilaterales de protección marítima. Particularmente, el capítulo antes mencionado estudia los programas emanados del seno de la Organización Marítima Internacional, de la Organización Mundial de Aduanas y de la Organización Internacional de Estandarización, como son el Código Internacional para la Protección de los Buques y de las Instalaciones Portuarias, el Marco Normativo de la Organización Mundial de Aduanas para Asegurar y Facilitar el Comercio Global y la norma ISO 28000: especificaciones de sistemas de gestión de la seguridad de las cadenas de suministro, respectivamente. Los capítulos VIII, IX y X estudian y comparan los programas de protección marítima de los Estados Unidos, de la Unión Europea y de México. En concreto, los capítulos antedichos analizan las obligaciones que imponen los programas de protección marítima a los distintos participantes en el transporte marítimo. Igualmente, los capítulos en mención estudian las competencias de las autoridades nacionales, que tienen a su carga la aplicación de los programas unilaterales.
