Available in PDF, EPUB and Kindle. Book excerpt: The reactivation of the Security Council at the beginning of the last decade has resulted, since the invasion of Kuwait by Iraq on August 2, l990, in increasing use of its powers under Chapter VII of the Charter and the adoption of measures against a number of state and non-state entities. The notion of a threat to the peace has now come to encompass violations of fundamental norms of international law such as human rights and humanitarian law, and the wide-ranging measures adopted have included such innovations as the establishment of the UN Compensation Commission or that of the two international criminal tribunals for Former Yugoslavia and Rwanda. These measures have not only infringed on the legal rights of the targeted state (sometimes with irreversible effects where they have remained in force over a long period of time) and its population, but also on those of implementing states and of private rights within these states. The current debate over the legitimacy and long-term effects of economic sanctions on states and their populations makes it imperative to re-evaluate this instrument and the broader peace maintenance function of the Security Council in the light of current community concerns. Part One of this book addresses the theoretical issues by focussing on: 1) The place of sanctions in the international legal system; 2) the limits to the powers of the Security Council and the question of accountability; and 3) an assessment of the alternatives to collective economic sanctions. Part Two looks at the relationship between sanctions and humanitarian issues, examining the relationship between: 1) Sanctions and human rights law; 2) sanctions, humanitarian issues and mandates; and 3) sanctions and humanitarian law. Part Three focuses on implementation by states of Security Council sanctions resolutions by examining: 1) Sanctions and private rights; and 2) special problems for implementing states. Part Four addresses the future in reassessing the place and ethics of sanctions in an international legal system which is giving increased importance to the individual. This work is based on papers presented at a colloquium of the Graduate Institute of International Studies in Geneva.

Book excerpt: In Israel/Palestine, Reinhart traces the development of the Security Barrier and Israel’s new doctrine of "disengagement," launched in response to a looming Palestinian-majority population. Examining the official record of recent diplomacy, including United States–brokered accords and talks at Camp David, Oslo, and Taba, Reinhart explores the fundamental power imbalances between the negotiating parties and identifies Israel’s strategy of creating facts on the ground to define and complicate the terms of any future settlement. In this indispensable primer, Reinhart’s searing insight illuminates the current conflict and suggests a path toward change.

Book excerpt: Michael Cronin looks at how translation has played a crucial role in shaping debates about identity, language and cultural survival in the past and in the present. He explores how everything from the impact of migration on the curricula for national literature courses, to the way in which nations wage war in the modern era is bound up with urgent questions of translation and identity. Examining translation practices and experiences across continents to show how translation is an integral part of how cultures are evolving, the volume presents new perspectives on how translation can be a powerful tool in enhancing difference and promoting intercultural dialogue. Drawing on a wide range of materials from official government reports to Shakespearean drama and Hollywood films, Cronin demonstrates how translation is central to any proper understanding of how cultural identity has emerged in human history, and suggests an innovative and positive vision of how translation can be used to deal with one of the most salient issues in an increasingly borderless world.

Book excerpt: The US administration’s pursuit of the Al-Qaeda organisation and Taliban régime in Afghanistan, responsible for the September 11, 2001 international terrorist attacks, was supported by an international “coalition of the willing” and backed by the full legal authority of UN Security Council Resolutions. The US bid to follow this successful multilateral initiative with similar armed intervention against Saddam Hussein’s government failed to rally support in the Security Council. The US then proceeded to act unilaterally, and with British military support, to invade Iraq. The problems for contemporary international law and the UN Charter based World Order system posed by the conflicts within the Security Council and the assorted legal claims advanced, such as a revived doctrine of Humanitarian Intervention; régime change as a justification for intervention; Preemptive military strikes as an exercise in Self-defence; and Multilateralism versus Unilateralism in the exercise of the Peace and Security powers under the UN Charter, are canvassed in the present collection of legal opinions.

Available in PDF, EPUB and Kindle. Book excerpt: Zacarias Moussaoui was arrested in the United States in August 2001. He is currently in a federal prison in Virginia, charged with "conspiring with Osama bin Laden and Al-Qaeda to murder thousands of innocent people in New York, Virginia, and Pennsylvania." Moussaoui , who trained to be a pilot in Oklahoma, admits to being a member of Al-Qaeda but denies involvement in the events of September 11. He has opted to defend himself. Written by his brother, Zacarias, My Brother tells the story of Zac’s life from birth to the time in 1996 when he broke contact with his family and became deeply involved with Muslim fundamentalists in London. It is a unique document about what it is to grow up a Muslim in Western Europe today and how an extremist is made. In Zacarias, My Brother, author Abd Samad Moussaoui describes the struggle that young Arab men and their families endure in Europe, seeking an education and equal opportunity, only to find most avenues of assimilation effectively barred to people of color. At the same time, he authoritatively details the techniques of the extremist sects that recruit potential terrorist cadres. Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.

Available in PDF, EPUB and Kindle. Book excerpt: Henri Lefebvre has been celebrated as one of the most influential social theorists of the twentieth century. Understanding Henri Lefebvre places Lefebvre in his historical and intellectual context and analyzes the extraordinary range of his work, across politics, philosophy, history, literature and culture. Particular emphasis is given to Lefebvre's trilogy of inspirational thinkers—Hegel, Marx and Nietzsche; his links to contemporaries such as Heidegger, Axelos and the Situationalists; and his critiques of existentialism and structuralism. Analysis of his writings on cities are balanced with those on rural communities, the production of space connected to ideas of time and history, and everyday life linked to the festival and cultural revolution. Understanding Henri Lefebvre offers the most wide-ranging and reliable account of this central theorist available.

Book excerpt: Now in a comprehensively updated edition, this indispensable handbook analyzes how international humanitarian law has evolved in the face of these many new challenges. Central concerns include the war on terror, new forms of armed conflict and humanitarian action, the emergence of international criminal justice, and the reshaping of fundamental rules and consensus in a multipolar world. ThePractical Guide to Humanitarian Law provides the precise meaning and content for over 200 terms such as terrorism, refugee, genocide, armed conflict, protection, peacekeeping, torture, and private military companies—words that the media has introduced into everyday conversation, yet whose legal and political meanings are often obscure. The Guide definitively explains the terms, concepts, and rules of humanitarian law in accessible and reader-friendly alphabetical entries. Written from the perspective of victims and those who provide assistance to them, the Guide outlines the dangers, spells out the law, and points the way toward dealing with violations of the law. Entries are complemented by analysis of the decisions of relevant courts; detailed bibliographic references; addresses, phone numbers, and Internet links to the organizations presented; a thematic index; and an up-to-date list of the status of ratification of more than thirty international conventions and treaties concerning humanitarian law, human rights, refugee law, and international criminal law. This unprecedented work is an invaluable reference for policy makers and opinion leaders, students, relief workers, and members of humanitarian organizations. Published in cooperation with Doctors Without Borders/Médecins Sans Frontières.

Available in PDF, EPUB and Kindle. Book excerpt: Self-defense and the right to go to war. Originally published: New York: Praeger, [1958]. xv, 294 pp. Bowett observes that the use or threat of force by any state can be a delict, an approved sanction, or a measure taken in self-defense. He examines the evolution of self-defense doctrine in the nineteenth and early-twentieth centuries, with the assumption of the existence of a state's unlimited 'right' to go to war. He then attempts to outline the limited and provisional effects of this right under the U.N. Charter. This book was written after Bowett's term as a United Nations legal officer from 1957-1959. "Throughout the work there is a refusal to dogmatize or to state in absolute terms any aspect of the 'privilege' of self-defence in its present context. (...) [Bowett] is to be congratulated on producing a timely and scholarly survey of one of the most fundamental, and often abused, sovereign rights known to international law." --K.R. Simmonds, British Year Book of International Law 34 (1958) 432. SIR DEREK WILLIAM BOWETT [1927-2009], an international lawyer, was President of Queens' College, Cambridge from 1969-1982 and Whewell Professor of International Law, Cambridge, from 1981-1991. He was awarded a CBE in 1983 and a knighthood in 1998.
