Il decreto inoltre punta molto sulla prevenzione della produzione dei rifiuti e su un nuovo modo di produrre eco-compatibile che viene denominato “economia circolare” (cioè un’economia pensata per potersi rigenerare da sola). Il volume analizza la nuova disciplina sul tema, mettendo in rilievo le differenze rispetto a quella precedente, indirizzando così l’operatore del settore sia pubblico che privato verso la corretta interpretazione ed applicazione del nuovo testo di legge. A tal fine è arricchito da una copiosa presenza della giurisprudenza penale e amministrativa.

La Direttiva stabilisce misure volte a proteggere l’ambiente e la salute umana evitando o riducendo la produzione di rifiuti, gli effetti negativi della produzione e della gestione dei rifiuti, riducendo gli effetti generali dell’uso delle risorse e migliorandone l’efficienza, che costituiscono elementi fondamentali per il passaggio a un’economia circolare e per assicurare la competitività a lungo termine dell’Unione. La direttiva introduce una «gerarchia dei rifiuti», cioè una "classifica" di scelte ambientali. - la prima scelta è la prevenzione (ridurre la quantità di rifiuti attraverso il riutilizzo dei prodotti); - la seconda è la preparazione per il riutilizzo; - la terza il riciclo; - la quarta il recupero. La quinta scelta (da evitare) è lo smaltimento (in discarica o tramite incenerimento). In questo senso, l'incenerimento deve essere funzionale al "recupero" e non alla distruzione.
