Book excerpt: Le phénomène de fragmentation reste assez complexe et se trouve mêlé à celui d'internormativité en ce sens qu'il englobe l'étude de la relation entre droit et société et, notamment, le droit international en tant que système juridique. La présente étude constitue, de manière générale, un essai sur l'œuvre de codification et de développement du droit international, en prenant en compte les récentes évolutions du droit international symbolisés dans ce que l'on qualifie, de plus en plus, de fragmentation du droit international. L'hypothèse gravite autour de l'extraordinaire expansion que connait cette discipline depuis près de cinquante ans et des changements survenus au niveau de ce qu'on appelle communément la « Communauté internationale ». L'intérêt est suscité par l'évolution des méthodes d'élaboration des normes du droit international, notamment du fait de la multiplication des organes compétents de l'ONU et le besoin de trouver des solutions pratiques au phénomène des conflits normatifs au niveau international. Ce sont là les deux conséquences (législative et institutionnelle) du phénomène de fragmentation qui menacent aujourd'hui l'ordre juridique international et l'unité du droit international. Il semble donc normal, compte tenu de cette situation, que se produise un nouvel essor de l'idée de codification du droit international.

Ils portent également atteinte à l'autonomie de la volonté de l'état. La règle pacta tertiis nec nocent nec prosunt ne souffre pas d'exception, mais l'existence d'actes, échappant au relativisme juridique, qui ont institué des régimes opposables à tous n'est plus à démontrer au regard de la pratique des états. En revanche, tenter de bâtir une théorie des situations objectives par la recherche des fondements juridiques qui lui sont propres ou inhérents à l'acte créateur, n'est pas sans poser de graves problèmes. Ceux-ci n'ont pas été surmontés par la commission du droit international, qui refuse de codifier les traités objectifs tout en reconnaissant que des situations juridiques sont régies par ce type d'acte, sans pour autant apporter des fondements juridiques. La règle de droit ne semble pas être en cause, mais l'utilisation par le passé de traités imposés pour créer des obligations à la charge d'états non parties a un accord ou n'ayant pas expressément consentis aux prescriptions d'un acte unilatéral, a profondément freiné la tentative de les codifier. Mais le malaise persiste, car paradoxalement, la notion, non codifiée dans le cadre du droit des traités, ne semble pas, au vu des travaux préparatoires, abandonnée, et on laisse à la coutume le soin de régler ce type de problèmes.

Some scholars see it as a new development, others as history repeating itself; some approach it as a technical issue and some as the reflection of deeper political struggles. But there is near-consensus about the fact that the established vision of international law as a unitary whole is under threat. At the core of the fragmentation debate lies the concept of unity, but this is hardly ever rationalised and is more assumed than explained. Its meaning remains vague and intuitive. 'The Concept of Unity in Public International Law' attempts to dispel that vagueness by exploring the various possible meanings of the concept of unity in international law. However, eschewing one grand theory of unity, it identifies and compares five candidates. Intentionally pluralistic in its outlook, the book does not engage in normative arguments about whether international law is or should be unitary but seeks to show instead that the concept of unity is contested and that discourses on fragmentation are necessarily contingent. The thesis on which the book is based won the 2009 Prize for best doctoral thesis from the Association des professeurs de droit du Québec.
