No se trata de hacer iguales a los desiguales, pretensiones, por otra parte inviables, sino de remover los obstáculos que impiden a las personas que sufren algún tipo de discapacidad el ejercicio de sus derechos, que, eso sí, son iguales para todos. La existencia de un colectivo amplio y heterogéneo de discapacitados en nuestra sociedad, exige un tratamiento jurídico adecuado que permita y haga efectivo el derecho que le asiste a vivir integrados en la sociedad. Esta obra que lleva por título «La discapacidad en el Derecho Administrativo», aborda un novedoso estudio completo y sistemático de la regulación de la discapacidad desde el punto de vista del Derecho Administrativo. Se toma como punto de partida el tratamiento internacional de las personas con discapacidad, su evolución y la importancia de la Convención Internacional de los Derechos de las personas con discapacidad, que ha determinado la necesaria adaptación de nuestra normativa a través de la reciente Ley 26/2011, de 1 de agosto. Así como también, cuál es el tratamiento de la discapacidad en el ámbito de la Unión Europea, en cuyo seno los esfuerzos realizados y los logros conseguidos son continuados, especialmente en su lucha por la igualdad de trato y no discriminación, con el claro objetivo de eliminar los obstáculos, y hacer desaparecer barreras medioambientales, de comportamiento, sociales, jurídicas, de comunicación, etc. En la segunda y tercera parte de esta obra se analizan las responsabilidades que corresponden a los poderes públicos para con las personas con discapacidad y cuál es su fundamento; los servicios que la Administración Pública ha de prestar; quién puede ser beneficiario de tales servicios; cómo deben prestarse los servicios; cuál es la Administración Pública competente para garantizar el acceso a tales servicios. Destacando, además, la importancia que tiene en este sector la intervención de entidades tuteladas, como la ONCE, así como también las asociaciones privadas representativas de personas con discapacidad, y el voluntariado. Todo ello comprende el régimen jurídico administrativo de los discapacitados, del que se derivan cuáles son sus derechos y cuáles son sus obligaciones. Finalmente, el reconocimiento de este derecho a vivir integrados en la sociedad, es especialmente necesario en aquellos ámbitos en los que precisamente su exclusión más se produce, y revela, por tanto, menores posibilidades de acceso a los derechos, a los bienes, a los servicios de la sociedad. En este sentido, se ofrece un estudio de los siguientes ámbitos sectoriales, en los que se exige una acción pública concreta: la accesibilidad y las condiciones básicas de accesibilidad en distintos sectores (oficinas públicas, bienes y servicios, tecnologías, etc.), con las modificaciones más recientes en relación con los objetivos de la Convención Internacional de los derechos de las Personas con Discapacidad. El acceso al empleo público y la provisión de puestos de trabajo de las personas con discapacidad. La contratación y la discapacidad. La dependencia y la discapacidad, teniendo en cuenta que no toda persona dependiente padece de una discapacidad, ni toda persona con discapacidad necesariamente ha de ser persona dependiente. La educación y la discapacidad, diferenciando la educación no universitaria y la educación universitaria. Se hace un análisis del colectivo específico de la mujer con discapacidad y el tema de la doble discriminación. Asimismo, el tratamiento del deporte adaptado, entendido el deporte como un valor de inclusión social. Y, en último lugar, se hace una referencia al acceso a los servicios sanitarios de las personas con discapacidad, especialmente los problemas derivados de la falta de información o del consentimiento informado.

Abundant evidence demonstrates that social inclusion can be planned and achieved. 7. Moving ahead will require a broader and deeper knowledge of exclusion and its impacts as well as taking concerted action.
