Il direttore dei lavori è nominato dal committente e deve curarne gli interessi, sorvegliando e impartendo le necessarie istruzioni per la corretta esecuzione dei lavori a regola d'arte secondo il contratto d’appalto; il suo operato tecnico è vincolante per il committente. Al direttore dei lavori compete l’alta vigilanza sulla regolare realizzazione dell’opera e sull’impiego dei materiali adatti, in quanto il medesimo assume un’obbligazione di mezzi e non di risultato riferita alla prestazione di un’attività intellettuale; i difetti dell’opera possono essere addebitati al direttore dei lavori solo qualora derivino da inosservanza dei suoi doveri di sorveglianza. Al di fuori dell’ambito tecnico-urbanistico (Norme tecniche per le costruzioni e D.P.R. 6 giugno 2001, n. 380), il direttore dei lavori non ha potere decisionale, perché tali compiti sono demandati al committente secondo le norme del Codice civile e della giurisprudenza in materia. Il direttore dei lavori nelle opere eseguite con riferimento al D.P.R. n. 380/2001 si assume rilevanti responsabilità sul piano penale e amministrativo asseverandone la correttezza esecutiva nel rispetto delle norme urbanistiche edilizie. Le difformità possono essere sempre rilevate in caso di lesioni di diritti di terzi. La nuova edizione include un capitolo dedicato al tema della sicurezza nei cantieri.
