Book excerpt: Si le droit de la presse est connu pour sa complexité, ce sont plus précisément son régime procédural dérogatoire et ses fameuses " chausse-trappes " qui sont redoutés des praticiens. Il n'existait pourtant jusqu'ici aucun ouvrage spécialement dédié à ces formidables difficultés procédurales, prévues essentiellement par la loi du 29 juillet 1881 sur la liberté de la presse. Tel est l'objet de celui-ci, centré sur les aspects pénaux du droit de la presse, qui seront néanmoins enrichis par différentes comparaisons avec le contentieux civil. Le droit de la presse est une matière qui est – ici comme ailleurs – envisagée largement, comme visant tout abus de la liberté d'expression : presse et édition, audiovisuel et (surtout) internet, et enfin certaines expressions, écrites ou orales, indépendamment de leur transmission par un quelconque média. Les expressions publiques et non-publiques sont donc concernées. C'est dans la spécificité de la procédure pénale de presse au regard du droit commun que réside l'intérêt de cet ouvrage, c'est donc autour de ses seules difficultés qu'il est construit – indépendamment, notamment, du contenu des incriminations, qui est cependant et nécessairement évoqué par endroits. Le plan est ainsi articulé autour de six parties : la prescription de l'action publique ; les acteurs du procès pénal de presse ; les investigations ; la saisine des juridictions ; le jugement de l'infraction de presse ; la contestation du procès pénal de presse. Si l'ouvrage a principalement vocation à aider les praticiens du droit de la presse, il intéressera tout autant les étudiants et universitaires soucieux de maîtriser les particularités de cette branche du droit pénal. Il est à jour au 1er juin 2019, et intègre les dernières évolutions jurisprudentielles et législatives, notamment celles issues de la loi n° 2019-222 du 23 mars 2019 de programmation 2018-2022 et de réforme pour la justice.
