Si bien en los últimos años se han dado avances normativos que permiten visibilizar, prevenir y enfrentar la violencia contra las mujeres por razones de género, y reconocer a las víctimas como titulares de derechos, existe una enorme brecha entre esos avances normativos y la realidad de las mujeres. El presente documento tiene como objeto explorar la situación de las mujeres víctimas de violaciones graves de los derechos humanos en el contexto del conflicto armado colombiano en relación con su acceso efectivo a la justicia. En este sentido, analiza si las mujeres que han sido víctimas de violencia de género con ocasión y en desarrollo del conflicto tienen un acceso efectivo a la justicia y evalúa las razones por las cuales no pueden gozar efectivamente de este derecho a pesar de que este está garantizado por la normatividad nacional y los estándares internacionales vinculantes para el Estado. El balance no es muy favorable, la investigación revela que las mujeres víctimas de violaciones graves de los derechos humanos ocurridas con ocasión y en desarrollo del conflicto armado enfrentan numerosas barreras para acceder efectivamente a la justicia, de allí que muchas de las atrocidades cometidas en su contra permanezcan en la impunidad

Book excerpt: La Ley 1448 de 2011, por la cual se dictan medidas de atención, asistencia y reparación integral a las víctimas del conflicto armado interno y se dictan otras disposiciones, o Ley de reparación integral, llamada también Ley de víctimas, es un novedoso instrumento legal de protección a las víctimas de la violencia en el marco del conflicto armado interno que afronta el país desde hace más de cincuenta años. Entre los ordenamientos promulgados al amparo de la Carta del 91, este es el mecanismo de defensa de los derechos humanos de más impacto después de la acción de tutela. Pero el campo de aplicación de la Ley comprende hechos ocurridos apenas a partir del 1° de enero de 1985. La Ley 1448 de 2011 es una norma de justicia transicional, como también lo son las Leyes 418 de 1997 (Instrumentos de convivencia, eficacia de la justicia y atención a las víctimas), 975 de 2005 (Justicia y Paz), 1424 de 2010 (Desmovilizados) y los Decretos 3391 de 2006 y 1290 de 2008 (Reparación administrativa en favor de las víctimas de la violencia), entre otros. Se trata de una regulación excepcional, con vigencia temporal de diez años contados desde el 10 de junio de 2011 al 9 de junio de 2021, que probablemente será prorrogable. Su objetivo esencial es la restitución para las víctimas de los derechos a la verdad, justicia, reparación y garantía de no repetición a través de diversas medidas, incluida la restitución de tierras despojadas o abandonadas forzosamente. Su objetivo final es ambientar un proceso de reconciliación y de paz sostenible.La Ley 1448 fue aprobada por el Congreso de la República el 1° de junio de 2011, sancionada por el Presidente de la República el 10 de junio del mismo año y publicada en el Diario Oficial N° 48.096. Su reglamentación inicial se acometió mediante los Decretos 2244, 4157, 4158, 4800, 4801, 4802, 4803 y 4829 de 2011 y 790 y 1725 de 2012. En la obra el autor consigna el articulado de la Ley 1448 de 2011 de este modo: cada artículo es seguido de notas explicativas y aclaratorias, definiciones, citas legislativas y jurisprudenciales, información histórica, reglamentación (Decretos 4800, 4801, 4802, 4803, 4829 y 2244 de 2011) y concordancia, todo esto, sin carga ideológica y con la mayor objetividad posible.
