A priori paradoxaux, ces rapports sont au coeur de cet ouvrage. Qu'elles préexistent au processus ou soient créées à sa faveur, les Cours constitutionnelles sont tout d'abord souvent saisies dans le cadre de la transition constitutionnelle elle-même. Les exemples de l'Afrique subsaharienne francophone, de la Russie, de l'Egypte et de la Pologne révèlent que si l'intervention du juge constitutionnel peut être vectrice de régulation et d'instauration de l'Etat de droit, elle peut au contraire conduire à politiser cette institution, voire à freiner la démocratisation. Cette ambiguïté transparaît également dans les interactions entre Justice constitutionnelle et Justice transitionnelle. Les exemples hongrois, espagnol et sud-africain montrent en effet que le juge constitutionnel peut certes garantir la Justice transitionnelle, mais peut également l'entraver selon la nature des dispositions incluses dans la Constitution. L'analyse des relations entre Justice constitutionnelle et transition démocratique s'avère ainsi riche d'enseignements quant à la première, comme quant à la seconde.
