Available in PDF, EPUB and Kindle. Book excerpt: Teachers of literature make judgments about value. They tell their students which works are powerful, beautiful, surprising, strange, or insightful—and thus, which are more worthy of time and attention than others. Yet the field of literary studies has largely disavowed judgments of artistic value on the grounds that they are inevitably rooted in prejudice or entangled in problems of social status. For several decades now, professors have called their work value-neutral, simply a means for students to gain cultural, political, or historical knowledge. ?Michael W. Clune’s provocative book challenges these objections to judgment and offers a positive account of literary studies as an institution of aesthetic education. It is impossible, Clune argues, to separate judgments about literary value from the practices of interpretation and analysis that constitute any viable model of literary expertise. Clune envisions a progressive politics freed from the strictures of dogmatic equality and enlivened by education in aesthetic judgment, transcending consumer culture and market preferences. Drawing on psychological and philosophical theories of knowledge and perception, Clune advocates for the cultivation of what John Keats called “negative capability,” the capacity to place existing criteria in doubt and to discover new concepts and new values in artworks. Moving from theory to practice, Clune takes up works by Keats, Emily Dickinson, Gwendolyn Brooks, Samuel Beckett, and Thomas Bernhard, showing how close reading—the profession’s traditional key skill—harnesses judgment to open new modes of perception.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Judgment in Literature In nearly all large towns, and especially in the capital cities of civilized nations, there are collections of statues, pictures, and books. Even in the streets we see the forms of men and women, wrought in marble or cast in bronze, placed high upon pedestals to meet the gaze of every one who may pass by them. In nearly every house there are pictures upon the walls, and vases or other ornaments arranged upon shelves, and books lying on the table; and in large houses there are whole chambers set apart solely for collections of pictures and statuary, or lined with rows of books. The mere existence of these objects shows us that Art is an element in the life of civilized man, for we should not care to surround ourselves with such things, unless we wished our minds to be sometimes occupied both with them and with the thoughts which they suggest. Criticism is the exercise of judgment in the province of Art and Literature, and the Critic is a person who is possessed of the knowledge necessary to enable him to pronounce right judgments upon the merit or worth of such works as come within this province. Available in PDF, EPUB and Kindle. Book excerpt: Robinson Crusoe recognizes it is foolish to leave for the open seas; nevertheless, he boards the ship. William Wordsworth of The Prelude sees the immense poetic task ahead of him, but instead of beginning work, he procrastinates by going for a walk. Centering on this sort of intentionally irrational action, originally defined as " akrasia" by the ancient Greeks and "weakness of will" in early Christian thought, Against Better Judgment argues that the phenomenon takes on renewed importance in the long eighteenth century. In treating human minds and bodies as systems and machines, Enlightenment philosophers did not account for actions that may be undermotivated, contradictory, or self-betraying. A number of authors, from Daniel Defoe and Samuel Johnson to Jane Austen and John Keats, however, took up the phenomenon in inventive ways. Thomas Manganaro traces how English novelists, essayists, and poets of the period sought to represent akrasia in ways philosophy cannot, leading them to develop techniques and ideas distinctive to literary writing, including new uses of irony, interpretation, and contradiction. In attempting to give shape to the ways people knowingly and freely fail themselves, these authors produced a new linguistic toolkit that distinguishes literature’s epistemological advantages when it comes to writing about people.

Book excerpt: **The Instant NEW YORK TIMES Bestseller** New York Times bestselling author Joseph Finder returns with an explosive new thriller about a female judge and the one personal misstep that could lead to her—and her family's—downfall. It was nothing more than a one-night stand. Juliana Brody, a judge in the Superior Court of Massachusetts, is rumored to be in consideration for the federal circuit, maybe someday the highest court in the land. At a conference in a Chicago hotel, she meets a gentle, vulnerable man and has an unforgettable night with him—something she’d never done before. They part with an explicit understanding that this must never happen again. But back home in Boston, Juliana realizes that this was no random encounter. The man from Chicago proves to have an integral role in a case she's presiding over--a sex-discrimination case that's received national attention. Juliana discovers that she's been entrapped, her night of infidelity captured on video. Strings are being pulled in high places, a terrifying unfolding conspiracy that will turn her life upside down. But soon it becomes clear that personal humiliation, even the possible destruction of her career, are the least of her concerns, as her own life and the lives of her family are put in mortal jeopardy. In the end, turning the tables on her adversaries will require her to be as ruthless as they are.

Available in PDF, EPUB and Kindle. Book excerpt: Good Judgment, based upon the author's experience as a lawyer, law professor, and judge, explores the role of the judge and the art of judging. Engaging with the American, English, and Commonwealth literature on the role of the judge in the common law tradition, Good Judgment addresses the following questions: What exactly do judges do? What is properly within their role and what falls outside? How do judges approach their decision-making task? In an attempt to explain and reconcile two fundamental features of judging, namely judicial choice and judicial discipline, this book explores the nature and extent of judicial choice in the common law legal tradition and the structural features of that tradition that control and constrain that element of choice. As Sharpe explains, the law does not always provide clear answers, and judges are often left with difficult choices to make, but the power of judicial choice is disciplined and constrained and judges are not free to decide cases according to their own personal sense of justice. Although Good Judgment is accessibly written to appeal to the non-specialist reader with an interest in the judicial process, it also tackles fundamental issues about the nature of law and the role of the judge and will be of particular interest to lawyers, judges, law students, and legal academics.

Available in PDF, EPUB and Kindle. Book excerpt: Judges are increasingly aware that the best way of enhancing public confidence in court systems is not only by providing a quality service but doing so compassionately and respectfully. The art and craft of judgment-writing is a critical element of this process. This book looks at the judgments of historically great judgment-writers from the US, UK and wider common law world (in particular Australia, Canada, India, Ireland, Israel and New Zealand). It is written not from the perspective of what the author can teach but with the aim of identifying essential elements of good judgment-writing in great judgments and insightful commentary.Written by Dr Max Barrett, a judge of the High Court of Ireland, individual chapters focus on subjects such as judgment purpose, length, style and structure, concurring and dissenting judgments, judgment-writing for children and vulnerable parties, as well as more general lessons in good writing offered by great authors from Orwell to Twain. Among the lessons to be taken from great common law judges are that: a good judgment possesses an ability to rise above immediate facts and to see a problem in its wider perspective;a sense of empathy/sympathy for those faring badly is always important; andthere is nothing wrong with language that is occasionally flowery and ornate; however, the best judgments are crisp and persuasive.A great author such as Mark Twain teaches, for example, that: every element of a judgment should be necessary to that judgment and any unnecessary element excised;any person or event included in a judgment should be included for a reason; anda judge should always use the right word for what she wants to state, 'not its second cousin'.This book is intended for novice superior court judges, their more seasoned colleagues and all with an interest in legal writing (including legal practitioners, law teachers and law students). Lower-court judges required to write judgments should find the book valuable; and judges at all levels should find the additional chapter on ex tempore judgments of use.
