Book excerpt: In the 1980s, the extent of Japanese export penetration into other Western economies, particularly the USA, became a matter of international concern. There were demands for Japan to reciprocate on imports, for the Japanese market to be 'opened up' and, by some people, for sanctions or a trade war if the Japanese did not respond. This book, first published in 1989, examines the growth of protectionist sentiment and the Japanese response to it. It examines in detail the debates within Japan and discusses the measures which the Japanese took, including the voluntary export restraint measure in the motor sector. It concludes that, broadly, the Japanese did indeed respond to world demands for their market to be opened up but that successful exporting to Japan depended equally on efforts by Western companies to service that market, which they were slow to do.

Book Synopsis Anticompetitive Practices in Japan by : Masaaki Kotabe
Download or read book Anticompetitive Practices in Japan written by Masaaki Kotabe and published by Praeger. This book was released on 1996-08-20 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: The U.S.-Japan bilateral trade relationship is perhaps the most consequential and the most tumultuous in the world. Government and business leaders devote substantial time and effort to resolving the stream of disputes that arise between the two allies and trading partners. Many of the issues are rooted in the perception that Japan's impressive economic success may be due in some degree to anticompetitive practices through which Japan's domestic markets are protected, and that an unfair advantage is granted to Japanese companies as they expand abroad. Regardless of the validity of these opinions, their existence exerts a negative influence upon this important bilateral relationship.

Book Synopsis The System of Unfair Competition Prevention in Japan by : Christopher Heath
Download or read book The System of Unfair Competition Prevention in Japan written by Christopher Heath and published by Springer. This book was released on 2001-05-02 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first in-depth treatment in English of Japanese law and practice governing unfair competition. The author analyzes the interaction of the relevant laws - and the case law derived from each - to present a systematic description of how business reputation, trade secrets, well-known marks, and other aspects of business achievement and investment are protected against undue exploitation in Japan. Prohibited acts of unfair competition covered include: misappropriation by confusion or passing-off; misappropriation through breach of trust or fiduciary duty; slavish imitation of distinct product features; trade mark piracy; tortious acts of denigration, libel, and slander; direct interference by, e.g., boycott or bribery; undue exercise of intellectual property rights; and misleading indications on goods and services (e.g., of geographical origin). Several problematic areas - in particular, the obstacles to effective enforcement, and the lack of adequate protection for consumers against acts of unfair competition - are given particular emphasis. The book concludes with cogent proposals on how the Japanese system could be improved and developed, referring to the model provisions of the World Intellectual Property Organization and offering a new and original draft Unfair Competition Act. Any business person or investor interested in the Japanese market will benefit enormously from this practical and insightful volume.

Book Synopsis MITI and the Japanese Miracle by : Chalmers Johnson
Download or read book MITI and the Japanese Miracle written by Chalmers Johnson and published by Stanford University Press. This book was released on 1982-06 with total page 818 pages. Available in PDF, EPUB and Kindle. Book excerpt: The focus of this book is on the Japanese economic bureaucracy, particularly on the famous Ministry of International Trade and Industry (MITI), as the leading state actor in the economy. Although MITI was not the only important agent affecting the economy, nor was the state as a whole always predominant, I do not want to be overly modest about the importance of this subject. The particular speed, form, and consequences of Japanese economic growth are not intelligible without reference to the contributions of MITI. Collaboration between the state and big business has long been acknowledged as the defining characteristic of the Japanese economic system, but for too long the state's role in this collaboration has been either condemned as overweening or dismissed as merely supportive, without anyone's ever analyzing the matter. The history of MITI is central to the economic and political history of modern Japan. Equally important, however, the methods and achievements of the Japanese economic bureaucracy are central to the continuing debate between advocates of the communist-type command economies and advocates of the Western-type mixed market economies. The fully bureaucratized command economies misallocate resources and stifle initiative; in order to function at all, they must lock up their populations behind iron curtains or other more or less impermeable barriers. The mixed market economies struggle to find ways to intrude politically determined priorities into their market systems without catching a bad case of the "English disease" or being frustrated by the American-type legal sprawl. The Japanese, of course, do not have all the answers. But given the fact that virtually all solutions to any of the critical problems of the late twentieth century--energy supply, environmental protection, technological innovation, and so forth--involve an expansion of official bureaucracy, the particular Japanese priorities and procedures are instructive. At the very least they should forewarn a foreign observer that the Japanese achievements were not won without a price being paid.
