Book excerpt: Questo saggio si prefigge lo scopo di illustrare le matrici ideali di uno dei due pilastri su cui si fonda l'Unione europea: il diritto, che è di derivazione prevalentemente romanistica, a fianco del Cristianesimo, unitamente al quale ultimo costituisce il carattere identitario della civiltà europea nel suo insieme e della cultura occidentale in senso lato, debitrice - non semprememore - anche verso l'Ebraismo e l'Islam, che nell'Età del Basso Medioevo vi esercitarono una non trascurabile influenza. Senza alcuna pretesa di completezza nell'affrontare un argomento di così ampia portata, che richiederebbe ben altri spazi di trattazione e di approfondimento, si vuole qui esporre nei punti essenziali e con lamaggiore chiarezza possibile, lo svolgimento di un pensiero ricco di apporti nel corso dei secoli, sul problema di una giustizia tendenzialmente universale. Il punto di partenza è idealmente dato dalla speculazione filosofica del mondo greco, che rappresenta l'età aurea - in termini di originalità e di profondità - per il disegno di una giustizia astrattamente sentita; così come ilmondo romano rappresenta il punto di partenza - con il suo rigore logico e sistematico - per la traduzione in concreto della giustizia medesima in precetti normativi destinati a durare nei secoli, grazie al loro contenuto intrinseco di razionalità. TITO LUCREZIO RIZZO (Roma,1952), Consigliere Capo Servizio della Presidenza della Repubblica, laureatosi in Giurisprudenza all'Università di Roma "La Sapienza" nel 1974 (110 e lode), è dal 1978 abilitato all'esercizio della professione di Avvocato. Professore di Storia del pensiero giuridico (Università Marconi - facoltà di Giurisprudenza); è anche Docente di Teoria generale del diritto (Masters di II livello presso le facoltà di Giurisprudenza e di Medicina dell'Università "La Sapienza"). Volume 8: A History of the Philosophy of Law in The Common Law World, 1600–1900 by Michael Lobban Volume 8, the third of the historical volumes, offers a history of legal philosophy in common-law countries from the 17th to the 19th century. Its main focus (like that of Volume 9) is on the ways in which jurists and legal philosophers thought about law and legal reasoning. The volume begins with a discussion of the ‘common law mind’ as it evolved in late medieval and early modern England. It goes on to examine the different jurisprudential traditions which developed in England and the United States, showing that while Coke’s vision of the common law continued to exert a strong influence on American jurists, in England a more positivist approach took root, which found its fullest articulation in the work of Bentham and Austin.
