Book excerpt: For decades, scholars have searched for data to show that Supreme Court justices are influenced not only by policy goals but also by legal considerations. Analyzing justices' agenda-setting decisions, we show that while justices are largely motivated by policy concerns, jurisprudential considerations can prevail over their policy goals. When policy goals and legal considerations collide, policy gives way. If legal considerations and policy goals align toward the same end, law liberates justices to pursue policy. In short, we find that at the intersection of law and politics, law is both a constraint on and an opportunity for justices.

Book excerpt: In this dissertation I develop and test a theory of legal change that views the U.S. Supreme Court as operating within a complex legal and political framework. I argue that the Court uses the process by which it decides cases as an institutional tool, allowing it to exert influence in the broader political and legal environment. The Court does this by allocating agenda space to specific types of issues over others, and also by articulating legal doctrine in its written opinions that helps to shape outcomes outside of the immediate case. I text the implications of this theory in the context of both the Court's agenda setting and its written opinions. I find evidence of influence in these contexts not only from the justices but also from a variety of policy entrepreneurs that have a stake in the outcomes on the Court.

Book excerpt: Research on the U.S. Supreme Court is ubiquitous, and has focused primarily on agenda setting at the primary access point (the certiorari stage) and on decision-making on the merits. In the course of this research, scholars have devised numerous ways to explain justice voting behavior. The main argument has been whether political attitudes motivates justice voting behavior, or whether internal and external variables pose constraints on the ability of the justices to realize their sincere preferences. This dissertation takes a new look at the factors motivating justice voting behavior by examining justiciability and jurisdictional issues (termed "secondary access"). The dissertation's goal is to develop a strategic model that incorporates pertinent influences on the individual justices' votes. The dissertation also builds institutional-level models of Court behavior to gauge the effectiveness of the behavioral models. The author finds that attitudes, the adherence to precedent, legal doctrine, public pressure, internal strategy, and preferences of Congress and the President all influence individual voting.

Book excerpt: This study builds on existing empirical separation of powers work to determine whether legislative and executive preferences constrain the Supreme Court's agenda. Its contribution comes in the form of a different modeling perspective regarding how the location of the status quo conditionally impacts the separation of powers dynamic -- namely, whether a judicial improvements over the status quo will avoid legislative overrides. The data suggest two things. First, the location of the status quo vis-a-vis key pivots does not appear to factor in to the Court's agenda calculations. Regardless of whether the Court was improving the status quo policy or making it worse for Congress and the president, the Court does not appear to consider legislative overrides. Second, these data more broadly suggest that the Court unlikely plays the separation of powers game with Congress and the president.
