Es el principal cuello de botella que impide que los delitos graves sean judicializados exitosamente. Esta etapa es también la que separa los casos obvios de los procesos difíciles: la mayoría de casos exitosos corresponde —desproporcionadamente— a flagrancias por asuntos que no son graves, y cuyos autores normalmente son personas de bajos recursos. Mientras que los casos graves y difíciles de investigar tienen muy bajas tasas de éxito en la investigación y se caracterizan por altísimos niveles de impunidad. Así pasa con los homicidios dolosos, que según las cuentas de este libro tienen un nivel de impunidad procesal de 95%. Los registros cuantitativos de la Fiscalía General de la Nación revelan que los esfuerzos de investigación son utilizados de manera irracional. La ausencia de una política de priorización estratégica —en contrapartida de una priorización escondida al arbitrio de los funcionarios que tramitan casos— impide que los esfuerzos de la política criminal se destinen a investigar lo más importante. Así mismo, el trabajo de campo cualitativo con el CTI de la Fiscalía muestra que las actividades de investigación de homicidios dolosos están desarticuladas, carecen de un liderazgo estratégico y ejecutivo, y no siguen iniciativas de indagación racional, analítica o creativa. La desorganización y la superficialidad de estos esfuerzos no le hacen partido a la complejidad del homicidio en nuestro país.
