After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.

Esso si propone di contribuire all’inquadramento giuridico del processo di trasformazione in atto nel diritto internazionale: un fenomeno in gran parte misterioso che sembra talora sfuggire, nella sua dimensione sistematica e nelle sue implicazioni tecniche, alle metodologie dell’analisi giuridica. L’idea di scrivere un libro dedicato alla ricostruzione degli aspetti generali dell’ordinamento internazionale si è lentamente fatta strada nella mia mente nel corso di vari anni. Essa si è nutrita soprattutto di attività di ricerca sulle varie forme attraverso le quali l’ordinamento internazionale provvede all’espletamento delle sue funzioni fondamentali: la funzione normativa, il controllo sull’uso della forza, la soluzione delle controversie. Se tradizionalmente queste funzioni venivano svolte in forma decentrata, attraverso l’azione unilaterale degli Stati, si può oggi cogliere una tendenza a realizzare forme di gestione istituzionale. La tensione fra l’esercizio decentralizzato e l’esercizio istituzionale di funzioni dell’ordinamento segna quindi l’intero percorso argomentativo di questo libro. A questo tema di fondo sono riconducibili una serie di altri itinerari concettuali che ho seguito in tempi più recenti. Il primo riguarda l’evoluzione in corso nella composizione della società internazionale. Ai protagonisti tradizionali delle dinamiche politiche dell’ordinamento, gli Stati, si affiancano oggi vari altri soggetti: in primo luogo soggetti istituzionali, gestori di interessi collettivi; in secondo luogo, soggetti individuali, portatori di interessi propri, sovente contraddittori con quelli statali, e titolari di un crescente numero di rapporti giuridici internazionali. Questa evoluzione si riflette quindi nella varietà delle forme di produzione e di legittimazione del diritto internazionale. La complessa composizione della società internazionale rende obsolete le concezioni che individuano nel consenso degli Stati il motore immobile dell’ordinamento. Parte di questo libro è quindi dedicata alle modifiche intervenute nei processi di produzione e di ricambio del diritto, che riflettono, a propria volta, l’evoluzione delle dinamiche sociali della comunità internazionale. Un ulteriore fattore di ispirazione di questo libro è dato dalla mutevole dinamica degli interessi e valori dell’ordinamento. Il diritto internazionale odierno è dominato dall’esigenza di comporre la tradizionale forma bilateralista dei rapporti giuridici internazionali con lo sviluppo di una sfera di interessi e valori di carattere collettivo o universale, quali i diritti e gli obblighi che incombono sugli individui. Questa esigenza nasce invero dall’evoluzione del mondo giuridico internazionale, tradizionalmente caratterizzato dalla contrapposizione fra interessi egoistici degli Stati, e oggi sempre più marcatamente influenzato dall’esistenza di interessi generali. Questi sparsi fili, tessuti nel corso di una riflessione pluriennale, sembrano quindi annodarsi nella ricostruzione dell’ordinamento internazionale come struttura di governo della comunità mondiale. La redazione di questo libro mi ha ulteriormente convinto che le tradizionali categorie del diritto internazionale, proprie di un mondo giuridico assai semplice, si rivelino inadeguate a disciplinare le ben più complesse dinamiche sociali odierne. Il diritto internazionale contemporaneo sembra sorretto da una pluralità di fattori di legittimazione: il consenso degli Stati; l’assetto reale del potere politico di ciascuno di essi; l’attività delle istituzioni internazionali; la percezione comune di valori condivisi da parte delle comunità di individui. È dalla composizione fra questi fattori, verosimilmente, che scaturiscono le regole che assicurano il governo della comunità mondiale. Nell’analisi di questo fenomeno risiede, forse, il contributo di questo libro all’intenso dibattito sulla capacità dell’ordinamento internazionale di assicurare tale funzione, talvolta indicata sinteticamente con la formula della costituzionalizzazione del diritto internazionale.
