En el sentido usado en este volumen, lo “crítico” no se reduce a las críticas marxistas o materialistas del derecho, abarca también los cuestionamientos al derecho comparado tradicional en los cuales se mantiene una distancia crítica con respecto a su objeto, el derecho, y se problematiza la posición privilegiada y la jerarquía que usualmente se le otorga al discurso jurídico.

Recuérdese el ejemplo clásico de las XII Tablas, en gran parte inspiradas en principios de origen griego, así como las precedentes influencias orientales sobre la legislación ateniense. Nada tiene que ver, sin embargo, esta absorción de leyes extranjeras, que parecidamente a los tiempos antiguos se repite en los días de hoy, con las investigaciones comparativas que los estudios modernos han impulsado y establecido como fundamento de una nueva rama del Derecho. El mismo jus gentium, elaborado por el Praetor peregrinus, mediante el uso de normas hasta entonces extrañas al derecho romano, es un resultado empírico de la práctica administrativa para adaptar el Derecho a los que no eran ciudadanos romanos, sin que ello revele en su origen, huellas de procedimiento científico en esta fusión de elementos diversos. Y es también dudoso que un desenvolvimiento de tal índole pueda ser reconocido cuando en la época clásica dicho cuerpo de Derecho, identificado por algunos con el jus naturale llega a ser ley casi mundial que, por tanto, resiente la influencia de las más varias nacionalidades.
