However, the demarcation of territory in most post-colonial states is extremely controversial since these physical dimensions were usually established during European colonial rule. The Roman doctrine of uti possidetis was called upon to add the thrust of legal sanctity and prevent challenge to boundaries bequeathed to the new ruler. By charting its progress through different temporal phases this book demonstrates that this doctrine evolved to suit political rather than legal tenets. Book excerpt: This book argues for the existence of a court enforceable human right to water that is implied from the right to life in Article 6 of the Namibian Constitution. The book builds this argument by using tools of constitutional interpretation and with the aid of comparative materials. As such, the African value of ubuntu is invoked. Ubuntu – which is legally developed through its four key principles of community, interdependence, dignity and solidarity – is anchored in a novel approach to Namibian constitutional interpretation that is conceptualised as ‘re-invigorative constitutionalism’. The book advances the ‘AQuA’ (adequacy – quality – accessibility) content of water and articulates the correlative duties within the context of the respect – protect – fulfil trilogy, which are duties imposed upon the Namibian state as the primary duty bearer for a right to water. These duties include irreducible essential content duties that are argued to be immediate when compared to general obligations. In giving substance to duties that flow from a right to water, international law interpretative resources are also relied upon, including General Comment No 15 by the United Nations Committee on Social, Economic and Cultural Rights, the African Commission’s Principles and Guidelines on Social and Economic Rights, and the World Health Organisation’s Drinking-water Quality Guidelines. Moreover, the book addresses various justiciability concerns that may arise, arguing that Namibian courts are institutionally competent and legitimate in enforcing right to water claims through the application of the bounded deliberation model. Book excerpt: Caprivi, the remote and narrow Namibian strip of land encapsulated by neighbouring Angola, Zambia and Botswana, has a contested colonial and postcolonial history. Bennett Kangumu traces the politics of its people in this complex borderlands since the late 19th century. Neglected by German and South African colonial administrations, its inhabitants were often pushed towards neighbouring territories though not being an integral part of them. At the same time, South African apartheid and homeland politics emphasised the ethnization of local identities. Becoming a strategic location in the ensuing liberation wars of the late 20th century, its history is often one of conquest and resistance, plunder, betrayal and rivalry. Kangumu shows how the inhabitants of Caprivi responded in various ways, notably in the form of regional nationalism when the Caprivi African National Union (CANU) was formed in the early 1960s. The Unions merger with the dominant Namibian liberation movement, SWAPO, was a claim to end seperation and isolation, which, however, flarred up again in post-colonial Namibia.

In Ruling Nature, Controlling People, Luregn Lenggenhager shows that these features were also characteristic of South African rule over the Caprivi Strip region in North-Eastern Namibia, especially in the fields of forestry, fisheries and, ultimately, wildlife conservation. In the process, the increasingly internationalised war in the region from the late 1960s until Namibias independence in 1990 became intricately interlinked with contemporary nature conservation, ecology and economic development projects. By retracing such interdependencies, Lenggenhager provides a novel perspective from which to examine the history of a region which has until now barely entered the focus of historical research. Drawing on previously untapped Ottoman archival evidence, Mostafa Minawi examines how the Ottoman participation in the Conference of Berlin and involvement in an aggressive competition for colonial possessions in Africa were part of a self-reimagining of this once powerful global empire. In so doing, Minawi redefines the parameters of agency in late-nineteenth-century colonialism to include the Ottoman Empire and turns the typical framework of a European colonizer and a non-European colonized on its head. Most importantly, Minawi offers a radical revision of nineteenth-century Middle East history by providing a counternarrative to the "Sick Man of Europe" trope, challenging the idea that the Ottomans were passive observers of the great European powers' negotiations over solutions to the so-called Eastern Question.
