Book excerpt: This volume argues on economic arguments that an internationally coordinated move towards EC - or even OECD-wide untying should be seriously considered. First, the empirical evidence in the book suggests it to be unlikely that aid-tying produced significant macroeconomic benefits in the donor economies. Furthermore, similar to the costs for the donor's national budget there are also tying costs for the recipients. Third, as far as aid-tying creates a 'rent' within the protected business community, this 'rent' is seldom transferred to the recipients. Finally, the linkage between aid-tying and the domestic constituency for aid seems rather weak. The economic analysis is placed against the background of recent policy discussions and decision-making on the issue, both in EC - and OECD-framework and focuses especially on the Helsinki-package operating since 1992.

On the basis of a comparative analysis the study shows how the co-ordination mechanisms available in the European Community and OECD have complicated the regulation of national policies on state aid to exporting industries. This failure can be explained in theoretical terms: international and supranational organisations are not neutral arbiters, but have interests of their own, interests which are not necessarily aligned with those of their member states. In detailed case studies of Britain, France and Germany the book examines how the preference structure of governments in the exercise of their promotion programmes contrasts with the policies enacted by international bureaucracies. Walzenbach’s interdisciplinary approach specifies the conditions under which policy co-ordination can have detrimental effects and thus, usefully corrects the benign view held by most regime theorists about transaction-cost reducing and efficiency enhancing role of such arrangement.

Book excerpt: This book is the first legal treatment of tied aid and examines in detail the compatibility of tied aid with EU and WTO law. The workings of the aid projects and aid procurement systems of donor countries granting bilateral aid are fully examined through case studies from the UK, Italy, the EU and the US. Tied aid refers to aid granted to developing countries on condition that goods and services for the aid-financed projects are purchased from the donor country only. The recipient country, in order to receive the grant or the loan, has no other choice but to fulfil the condition imposed by the donor. Economists have shown that tying aid undermines the effectiveness of aid. It leads to higher costs paid for the goods and services purchased and the distortion of the nature of the aid. Further, tying frustrates the potential of aid to foster trade between developing countries - in many of these countries public bodies and, in particular, aid-financed projects are major potential outlets for trade between neighbouring states. The importance of tied aid has been pointed out in economic literature but there is surprisingly little written on the legal aspects of tied aid practices and this book seeks to fill this major gap in the literature. The book is of interest to academics in the field of EU and WTO law, NGOs and practitioners working both in the field of public procurement and development policies.
