Discretely focused subheadings allow users to precisely pinpoint relevant discussions, and footnotes highlight helpful resources and explanations. The chapters address issues as they commonly arise through the litigation process--from considering the elements of a malpractice cause of action, through investigating and preparing a case, to managing trial issues. Chapters are organized to address the issues as they commonly arise for the practicing attorney through the litigation process, from evaluation of potential claims and consideration of the elements of a malpractice cause of action, through pretrial investigation and case preparation, and finally, to the trial. Footnotes provide helpful explanatory information and resources, and add to the ease of finding answers quickly. Descriptive and discretely focused subheadings allow the reader to pinpoint precisely the discussion most relevant to his or her concerns. Practice pointers appear at the end of each chapter to aid in navigating complex medical malpractice cases. Chapters 1 and 2 discuss the first essential component of medical malpractice causes of action, the breach of a health care provider's duty of care or failure to obtain informed consent. Chapter 3 addresses related but distinct causes of action such as assault and battery, fraud, breach of contract, medical records alteration or destruction and sexual misconduct. Chapters 4 and 5 discuss the second and third essential components of malpractice cases, causation, and damages. Chapter 4 has been revised to keep pace with the evolving complex case law governing proof of proximate causation in cases involving pre-existing injuries, delayed cancer diagnoses and avoidable consequences. Chapter 5 discusses damages claims in general, and those particular to malpractice and wrongful death causes of action. Chapters 6 through 9 deal with issues related to pretrial proceedings and trial of malpractice cases, including pre-suit investigation of such claims. Chapter 7 has been revised to discuss the rapidly changing case law regarding the affidavit of merit, pretrial discovery, and presents an extremely thorough discussion of expert testimony, particularly as it evolves through the implementation of the New Jersey Medical Care Access and Responsibility and Patients First Act. These chapters also examine the pleadings, defenses including the statute of limitations, voir dire and jury charges specific to malpractice cases. Finally, Chapter 10 provides a thorough discussion of the federal and New Jersey statutes and regulations regarding electronic medical records. ,

Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.

Available in PDF, EPUB and Kindle. Book excerpt: Physical attractiveness of the face has a significant impact on the social life and daily interaction of individuals as well as one’s general perception of life. Proper surgical planning for aesthetic facial surgery requires a meticulous analysis of the patient’s current and desired facial features from the perspective of both soft and hard tissues. Significantly greater changes to facial aesthetics can be made via the alteration of the main bony structures of the face than by alteration of soft tissue and skin alone. Various surgical and clinical techniques are available for the augmentation, reduction or refinement of the most prominent aspects of facial aesthetics, such as alterations to the cheek, chin, nose, para-nasal area, as well as the angle of the jaw. These techniques can be categorized as office-based or non-invasive techniques (filler injections, facial liposculpture or liposuction to modify the soft tissue of the face) and invasive surgical interventions such as facial prosthesis and maxillofacial osteotomies. In order to achieve the optimum aesthetic results for patients who undergo bi-maxillary or mono-maxillary orthognathic surgery, it is of paramount importance to utilize a hard and soft-tissue integrated approach. These integrated approaches have utilized the latest techniques in 3-dimentional printing, computer-assisted surgery, tissue engineering and stem-cell therapy in order to achieve positive and lasting outcomes. Integrated Procedures in Facial Cosmetic Surgery includes chapters that focus on facial analysis and clinical evaluation and best practices in surgical techniques such as: principles of bone contouring; genioplasty; mentoplasty; malarplasty; rhinoplasty; orthognatic surgery and intra-oral plastic surgery; lifting procedures like blepharoplasty; surgical approaches to cleft lip and palate surgery; as well as the principles of facial photography. Written by a team of renowned international experts, this textbook features over 900 original photographs, fully illustrating each procedure in a stepwise manner. Integrated Procedures in Facial Cosmetic Surgery is an essential companion for oral and maxillofacial surgeons, plastic surgeons and otolaryngologists, as well as for cosmetic surgeons and clinical residents dealing with face rejuvenation. Its contents will also be of interest to dentists, prosthodontists, periodontists, radiologists, general surgeons, and dermatologists.

Book excerpt: Science educators in the United States are adapting to a new vision of how students learn science. Children are natural explorers and their observations and intuitions about the world around them are the foundation for science learning. Unfortunately, the way science has been taught in the United States has not always taken advantage of those attributes. Some students who successfully complete their Kâ€"12 science classes have not really had the chance to "do" science for themselves in ways that harness their natural curiosity and understanding of the world around them. The introduction of the Next Generation Science Standards led many states, schools, and districts to change curricula, instruction, and professional development to align with the standards. Therefore existing assessmentsâ€"whatever their purposeâ€"cannot be used to measure the full range of activities and interactions happening in science classrooms that have adapted to these ideas because they were not designed to do so. Seeing Students Learn Science is meant to help educators improve their understanding of how students learn science and guide the adaptation of their instruction and approach to assessment. It includes examples of innovative assessment formats, ways to embed assessments in engaging classroom activities, and ideas for interpreting and using novel kinds of assessment information. It provides ideas and questions educators can use to reflect on what they can adapt right away and what they can work toward more gradually.

Book excerpt: Comprehensive Criminal Procedure, Fifth Edition is perfect for all introductory courses in criminal procedure law (including both investigation and adjudication courses, as well as comprehensive and survey courses). The casebook focuses primarily on constitutional criminal procedure law, but also covers relevant statutes and court rules. The casebook is deliberately challenging—it is designed for teachers who want to explore deeply not only the contemporary state of the law, but also its historical and theoretical foundations. The casebook incorporates a particular emphasis on empirical knowledge about the real-world impacts of law-in-action; the significance of race and class; the close relationship between criminal procedure law and substantive criminal law; the cold reality that hard choices sometimes must be made in a world of limited criminal justice resources; and, finally, the recognition that criminal procedure law always should strive to achieve both fairness to the accused and justice for society as a whole. New to the Fifth Edition: Cutting edge developments in caselaw, statutory material, and academic commentary An important reordering of certain areas of the Fourth Amendment and related materials that make them even more user-friendly Insightful examination of the turmoil in the modern Fourth Amendment cases as the Supreme Court, notably splintered over the appropriate methods of interpreting the Constitution, faces the implications of rapidly changing technology. The latest in case law, statutory material, and academic commentary about due process, the right to counsel, pretrial practice, guilty pleas, trial rights, sentencing, double jeopardy, and post-trial procedures Increased emphasis on the role of prosecutorial decision-making An updated treatment of the critical role of plea bargaining A new section on forfeitures and the Eighth Amendment Professors and students will benefit from: A rigorous and challenging criminal procedure casebook with careful presentation and editing A prestigious author team that incorporates the latest and most highly respected developments in legal scholarship in the field of criminal procedure law An appropriate balance of explanatory text and secondary material Thematic organization structured around important main themes Extensive revisions and updates A casebook that is the only criminal procedure casebook on the market today that enables students to understand the roots of the modern controversy over privacy and security in a digital age

Book excerpt: Health Impact Assessment is a policy-support instrument and approach that seeks to assess the health impacts of projects, programmes and policies on population health. The ultimate goal of HIA is to systematically predict health impacts and subsequently inform the intersectoral decision- and policy-making processes of these impacts. Integrating Health Impact Assessment with the Policy Process examines how the process of integrating HIA with policy can take place. Introductory chapters outline the HIA process and provide a conceptual foundation for the book. Then, drawing from experiences of HIA practice and research globally, country specific experiences are presented to examine HIA's relationship with the policy process. Throughout the book checklists and learning points are provided to assist the readers' understanding of the concepts and examples discussed. This practical and conceptually-grounded guide represents a convergence of theory and practice from the disciplines of public health, environmental health and the social sciences, and will appeal to practitioners and professionals in these fields, as well as policy-makers, decision-makers, planners at regional and national government levels as well as academics, educators and students.

Available in PDF, EPUB and Kindle. Book excerpt: A powerful new argument for reviving the ideal of racial integration More than forty years have passed since Congress, in response to the Civil Rights Movement, enacted sweeping antidiscrimination laws in the Civil Rights Act of 1964, the Voting Rights Act of 1965, and the Fair Housing Act of 1968. As a signal achievement of that legacy, in 2008, Americans elected their first African American president. Some would argue that we have finally arrived at a postracial America, but The Imperative of Integration indicates otherwise. Elizabeth Anderson demonstrates that, despite progress toward racial equality, African Americans remain disadvantaged on virtually all measures of well-being. Segregation remains a key cause of these problems, and Anderson skillfully shows why racial integration is needed to address these issues. Weaving together extensive social science findings—in economics, sociology, and psychology—with political theory, this book provides a compelling argument for reviving the ideal of racial integration to overcome injustice and inequality, and to build a better democracy. Considering the effects of segregation and integration across multiple social arenas, Anderson exposes the deficiencies of racial views on both the right and the left. She reveals the limitations of conservative explanations for black disadvantage in terms of cultural pathology within the black community and explains why color blindness is morally misguided. Multicultural celebrations of group differences are also not enough to solve our racial problems. Anderson provides a distinctive rationale for affirmative action as a tool for promoting integration, and explores how integration can be practiced beyond affirmative action. Offering an expansive model for practicing political philosophy in close collaboration with the social sciences, this book is a trenchant examination of how racial integration can lead to a more robust and responsive democracy.
