Book excerpt: Excerpt from Inquiries Elementary and Historical in the Science of Law Some apology may, perhaps, seem requisite, for a practical lawyer allotting any portion of his time to studies so much apart from the routine and technicalities of ordinary business, as those, which form the subject of the following inquiries. The author's original design was the composition of practical treatises on the principles of maritime and commercial law, national and international. But from his having devoted himself to the discharge of the duties of a provincial semi-judicial office, and from his consequent want of leisure, he was, in the former of those projects, fortunately for the public, anticipated by his friend, the present learned Professor of the Law of Scotland in the University of Edinburgh, enlarging his excellent treatise on Bankruptcy, into his still more valuable commentaries on the principles of Mercantile Jurisprudence. Book Synopsis Scientific Research in Education by : National Research Council
Download or read book Scientific Research in Education written by National Research Council and published by National Academies Press. This book was released on 2002-03-28 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: Researchers, historians, and philosophers of science have debated the nature of scientific research in education for more than 100 years. Recent enthusiasm for "evidence-based" policy and practice in educationâ€"now codified in the federal law that authorizes the bulk of elementary and secondary education programsâ€"have brought a new sense of urgency to understanding the ways in which the basic tenets of science manifest in the study of teaching, learning, and schooling. Scientific Research in Education describes the similarities and differences between scientific inquiry in education and scientific inquiry in other fields and disciplines and provides a number of examples to illustrate these ideas. Its main argument is that all scientific endeavors share a common set of principles, and that each fieldâ€"including education researchâ€"develops a specialization that accounts for the particulars of what is being studied. The book also provides suggestions for how the federal government can best support high-quality scientific research in education.
Book Synopsis International Law Theories by : Andrea Bianchi
Download or read book International Law Theories written by Andrea Bianchi and published by Oxford University Press. This book was released on 2016-11-10 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: Two fish are swimming in a pond. 'Do you know what?' the fish asks his friend. 'No, tell me.' 'I was talking to a frog the other day. And he told me that we are surrounded by water!' His friend looks at him with great scepticism: 'Water? Whats that? Show me some water!' International lawyers often find themselves focused on the practice of the law rather than the underlying theories. This book is an attempt to stir up 'the water' that international lawyers swim in. It analyses a range of theoretical approaches to international law and invites readers to engage with different ways of legal thinking in order to familiarize themselves with the water all around us, of which we hardly have any perception. The main aim of this book is to provide interested scholars, practitioners, and students of international law and other disciplines with an introduction to various international legal theories, their genealogies, and possible critiques. By providing an analytical approach to international legal theory, the book encourages readers to enhance their sensitivity to these different approaches and to consider how the presuppositions behind each theory affect analysis, research, and practice in international law. International Law Theories is intended to assist students, scholars, and practitioners in reflecting more generally about how knowledge is formed in the field.

Book Synopsis Laws And Explanation In The Social Sciences by : Lee C Mcintyre
Download or read book Laws And Explanation In The Social Sciences written by Lee C Mcintyre and published by Routledge. This book was released on 2018-10-08 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first full-length defense of social scientific laws to appear in the last twenty years, this book upholds the prospect of the nomological explanation of human behavior against those who maintain that this approach is impossible, impractical, or irrelevant. By pursuing an analogy with the natural sciences, Mclntyre shows that the barriers to nomological inquiry within the social sciences are not generated by factors unique to social inquiry, but arise from a largely common set of problems that face any scientific endeavor. All of the most widely supported arguments against social scientific laws have failed largely due to adherence to a highly idealized conception of nomologicality (allegedly drawn from the natural sciences themselves) and the limited doctrine of "descriptivism." Basing his arguments upon a more realistic view of scientific theorizing that emphasizes the pivotal role of "redescription" in aiding the search for scientific laws, Mclntyre is optimistic about attaining useful law-like explanations of human behavior.
Download or read book No Magic Wand written by David S. Caudill and published by Rowman & Littlefield Publishers. This book was released on 2006-06-29 with total page 169 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since 1993, Supreme Court precedent has asked judges to serve as gatekeepers to their expert witnesses, admitting only reliable scientific testimony. Lacking a strong background in science, however, some judges admit dubious scientific testimony packages by articulate practitioners, while others reject reliable evidence that is unreasonably portrayed as full of holes. Seeking a balance between undue deference and undeserved skepticism, Caudill and LaRue draw on the philosophy of science to help judges, juries, and advocates better understand its goals and limitations.
