Book Synopsis UN Security Council Referrals to the International Criminal Court by : Alexandre Skander Galand
Download or read book UN Security Council Referrals to the International Criminal Court written by Alexandre Skander Galand and published by BRILL. This book was released on 2018-11-26 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a unique critical analysis of the legal nature, effects and limits of UN Security Council referrals to the International Criminal Court (ICC). Alexandre Skander Galand provides, for the first time, a full picture of two competing understandings of the nature of the Security Council referrals to the ICC, and their respective normative interplay with legal barriers to the exercise of universal prescriptive and adjudicative jurisdiction. The book shows that the application of the Rome Statute through a Security Council referral is inherently limited by the UN Charter as well as the Rome Statute, and can conflict with other branches of international law, including international human rights law, the law on immunities and the law of treaties. Hence, it spells out a conception of the nature and effects of Security Council referrals that responds to these limits and, in turn, informs the reader on the nature of the ICC itself.

Book Synopsis The Chapter VII Powers of the United Nations Security Council by : Erika de Wet
Download or read book The Chapter VII Powers of the United Nations Security Council written by Erika de Wet and published by Bloomsbury Publishing. This book was released on 2004-01-23 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study provides a comprehensive analysis of the questions pertaining to the powers of the Security Council under Chapter VII of the Charter of the United Nations. In doing so it departs from the premise that an analysis of the limitations to the powers of the Security Council and an analysis of judicial review of such limitations by the ICJ, respectively, are inter-dependent. On the one hand, judicial review would only become relevant if and to the extent that the powers granted to the Security Council under Chapter VII of the Charter are subject to justiciable limitations. On the other hand, the relevance of any limitation to the powers of the Security Council would remain limited if it could not be enforced by judicial review. This inter-dependence is reflected by the fact that Chapters 2 and 3 focus on judicial review in advisory and contentious proceedings, respectively, whereas Chapters 4 to 9 examine the limits to the powers of the Security Council. The concluding chapter subsequently illuminates how the respective limits to the Security Council's enforcement powers could be enforced by judicial review. It also explores an alternative mode of review of binding Security Council decisions that could complement judicial review by the ICJ, notably the right of states to reject illegal Security Council decisions as a 'right of last resort'. The space and attention devoted to the limits to the Security Council's enforcement powers reflects the second aim of this study, namely to provide new direction to this aspect of the debate on the Security Council's powers under Chapter VII of the Charter. It does so by paying particular attention to the role of human rights norms in limiting the type of enforcement measures that the Security Council can resort to in order to maintain or restore international peace and security.
Book Synopsis The International Criminal Court and the Crime of Aggression by : Mauro Politi
Download or read book The International Criminal Court and the Crime of Aggression written by Mauro Politi and published by Routledge. This book was released on 2017-09-29 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Rome Statute of the International Criminal Court entered into force in 2002 and the ICC will soon be fully operational. Earlier in the ICC process, an international conference was held in Trento to address a specific issue that is still unresolved in the post-Rome negotiations: the crime of aggression. Article 5 of the ICC Statute includes aggression, yet the Statute postpones the exercise of its jurisdiction over the crime of aggression until such time as further provisions have been prepared on the definition of this crime and on the related conditions for the Court's intervention. This important volume collects the papers given by the participants at the Trento Conference. The volume is divided into three parts: the historical background of the crime of aggression; the definition of the crime of aggression, in light of proposals in the Preparatory Commission; and various points of view on the relationship between the Court's competence in adjudicating cases of alleged crimes of aggression and the Security Council's competence.
Book Synopsis The UN Security Council by : David Malone
Download or read book The UN Security Council written by David Malone and published by Lynne Rienner Publishers. This book was released on 2004 with total page 764 pages. Available in PDF, EPUB and Kindle. Book excerpt: The nature and scope of UN Security Council decisions - significantly changed in the post-Cold War era - have enormous implications for the conduct of foreign policy. The UN Security Council offers a comprehensive view of the council both internally and as a key player in world politics. Focusing on the evolution of the council's treatment of key issues, the authors discuss new concerns that must be accommodated in the decisionmaking process, the challenges of enforcement, and shifting personal and institutional factors. Case studies complement the rich thematic chapters. The book sheds much-needed light on the central events and trends of the past decade and their critical importance for the future role of the council and the UN in the sphere of international security.
Book Synopsis UN Security Council Reform by : Peter Nadin
Download or read book UN Security Council Reform written by Peter Nadin and published by Routledge. This book was released on 2016-02-22 with total page 147 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume comprehensively evaluates the current state and future reform prospects of the UN Security Council, providing the most accessible and rigorous treatment of the subject of reform to date. Apart from a couple of critical eyes in the academic community, few have asked the pertinent questions that this volume seeks to address: Will the enlargement of the Council constitute a reform? Could the inclusion of countries such as India, Germany, Japan, and Brazil markedly improve the Council’s agency? In response, this book focuses on: The Role and Agency of the UN Security Council The History of the Reform Debate An Expanded Council Working Method Reforms Enhancing Agency As the future of the UN Security Council continues to be the focus of fierce debate, this book will be essential reading for students of international relations, international organizations and international security studies alike.
