Book excerpt: Excerpt from Report of the Judgment of the Court of Queen's Bench, in the Braintree Church-Rate Case: Gosling V. Veley and Joslin Loan denman We have now to give our judgment in this case, which, from its importance and its difficulty, and other circumstances, has been delayed longer than we could have wished. In so doing, it will be necessary to go into a history of the transactions which have given existence to the cause; and the rather as in the course of our observations we shall think it right to examine minutely the allegations upon the record, upon which alone our decision must turn. Download or read book Recovering Canada written by John Borrows and published by University of Toronto Press. This book was released on 2017-06-22 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada is covered by a system of law and governance that largely obscures and ignores the presence of pre-existing Indigenous regimes. Indigenous law, however, has continuing relevance for both Aboriginal peoples and the Canadian state. In his in-depth examination of the continued existence and application of Indigenous legal values, John Borrows suggests how First Nations laws could be applied by Canadian courts, and tempers this by pointing out the many difficulties that would occur if the courts attempted to follow such an approach. By contrasting and comparing Aboriginal stories and Canadian case law, and interweaving political commentary, Borrows argues that there is a better way to constitute Aboriginal / Crown relations in Canada. He suggests that the application of Indigenous legal perspectives to a broad spectrum of issues that confront us as humans will help Canada recover from its colonial past, and help Indigenous people recover their country. Borrows concludes by demonstrating how Indigenous peoples' law could be more fully and consciously integrated with Canadian law to produce a society where two world views can co-exist and a different vision of the Canadian constitution and citizenship can be created.

Download or read book Human Behavior and Environment written by Irwin Altman and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The papers comprising this second volume of Human Behavior and the Environment represent, as do their predecessors, a cross section of current work in the broad area of problems dealing with interrelation ships between the physical environment and human behavior, at both the individual and the aggregate levels. Considering the two volumes as a unit, we have included papers covering a broad spectrum of problems ranging from the theoretical to the applied, and from the disciplinary-based to the interdisciplinary and professional. Approxi mately half of the papers are written by psychologists, with the remainder coming, in part, from such other disciplines as sociology, geography, and from such diverse applied and professional fields as natural recreation, landscape architecture, urban planning, and opera tions research. The volumes thus provide an overview of work on current topical problems. Yet, as the field is developing, specialization is inevitably increasing apace, and the editors as well as the publisher have become convinced of the desirability for futu're volumes in this series to be organized along topical lines, with successive volumes devoted to different aspects of this rather sprawling field. Thus, Volume 3, currently in the planning stage, will be devoted exclusively to the interaction of children with the physical environment, considered from diverse viewpoints, again including authors from diverse fields of specialization.
Book Synopsis The Crash of Ruin by : Peter Schrijvers
Download or read book The Crash of Ruin written by Peter Schrijvers and published by Springer. This book was released on 1997-11-10 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a compelling account of how America's combat soldiers experienced Europe during World War II. It paints a vivid picture of the GIs' struggles with its natural surroundings, their confrontations with its soldiers, their encounters with its civilians, and their reactions to uncovering the holocaust. The book shows how these harrowing experiences convinced the American soldiers that Europe's collapse was not just the result of the war, but also of the Old World's deep-seated political cynicism, economic stagnation, and cultural decadence.
