This book drills down to the country level to study both sides of this equation, examining how state regulation and nonprofit self-regulation affect each other and investigating the causal nature of this interaction. Abstract: Private non-enterprise institutions (PNIs, minban feiqiye danwei 民辦非企業單位 or minfei 民非), one of the three types of nonprofit organizations in China, mainly exist in a wide range of human service fields, e.g. education, health-care, and social welfare. Thus, PNIs are addressed as nonprofit human service organizations in this study. Despite their relatively short history, PNIs have grown dramatically in size and influence since the late 1990s. Today they constitute an integral and increasingly important part of the charitable sector in China. However, to date research into the legal and regulatory framework for PNIs has been limited. This study examines the legal and regulatory framework for PNIs in the broader context of China's ongoing charity law reform. In the wake of charity scandals in 2011, the past few years have seen a new wave of charity law reform in China, characterized by an accelerated process of drafting the long-awaited Charity Law. This vital piece of legislation is likely to bring the charitable sector of the country to a new stage of development where a more supportive legal environment can enable further development of this sector on the one hand, and more vigorous and effective oversight can restore public trust and confidence on the other. For charity law reform in China to succeed, a richer and deeper understanding is needed of the legal and regulatory framework for PNIs. This study presents a theoretical framework for the study of nonprofit human service organizations that is built on an integration of demand-side and supply-side theories, and uses it to examine the development of PNIs in post-1978 China. In particular, relying primarily on data analysis, this study reveals that the supply of nonprofit production of human services in China is still unable to meet the growing demand. Given this, PNIs are unlikely to have a comparative advantage over public agencies and private for-profit producers. This demand-supply mismatch, as this study makes clear, is due largely to the uncertainty surrounding the legal status of PNIs. In view of the extraordinary challenges facing the development of PNIs, this study explores some suggested directions toward improving the legal and regulatory framework for PNIs against the backdrop of charity law reform in China. First, based on a comparative analysis of civil law and common law approaches to recognizing nonprofit organizations, as well as case studies, this study highlights the need to clarify and recognize the nonprofit and charitable status as well as tax-exempt status of PNIs, and investigates the present state and future development of relevant issues. Second, this study looks closely at the means by which greater accountability and transparency of PNIs can be achieved, aiming to prevent abuse of this legal status. Bearing in mind the regulatory challenges posed by the emergence of multiple-entity groups (or "social enterprise groups") in the third sector in China, this study analyzes and proposes regulatory oversight mechanisms that should be put in place as charity law reform goes forward. Book excerpt: Recently, public confidence in the charitable sector has eroded due to a barrage of media reports on scandals and abuses. The principal parties charged with regulation of the charitable sector, the Internal Revenue Service and state attorneys general, are saddled with bureaucratic constraints that make it difficult to enforce the laws governing the fiduciary responsibilities of charity managers. Substantial reform in the regulation of charitable organizations is necessary to curb the reported abuses that have undermined confidence in the charitable sector. Some advocate expanding private regulation of the charitable sector to improve enforcement of the fiduciary responsibilities of charitable managers. While some of these private regulatory alternatives have had success in isolated situations, none are satisfactory in providing comprehensive and effective oversight of the charitable sector. Overall, the policies underlying oversight of charitable organizations support maintaining primary responsibility for their regulation in a centralized authority. However, the financial, political, institutional, and agency constraints imposed on the Internal Revenue Service and state attorneys general make them unlikely to implement enough internal reform to be an ongoing, effective enforcement presence in the charitable sector. This Article advocates the creation of a new, federal, quasi-public agency that would be the principal regulator of the charitable sector. The new agency would be a self-funded, independent, and proactive regulator that would serve the dual purposes of curbing the abuses that have eroded public confidence in the sector and educating charity managers of their obligation to be responsible stewards of charitable resources. The proposed agency would be primarily responsible for enforcing federal tax laws aimed at influencing fiduciary behavior of charity managers and preserving charitable assets for public benefit. Its formation, therefore, would separate oversight of charity governance from the tax collection function, thus harmonizing the United States with other countries that have established independent charity oversight agencies.

Book excerpt: The Charity Commission is not regulating charities effectively and there is a gap between what the public expects of the Commission and what it actually does. The NAO has concluded that the Commission does not do enough to identify and tackle abuse of charitable status. Between 2007-08 and 2013-14, the Commission's annual budget fell 40 per cent in real terms to £22.7 million but the number of main registered charities has remained fairly constant at around 160,000. In response to budget cuts, the Commission has reviewed how it works and successfully reduced demand for its services, but it has not identified what budget it would need to regulate effectively. The Commission makes little use of its enforcement powers, for example suspending only two trustees and removing none in 2012-13. And it can be slow to act when investigating regulatory concerns. The NAO found cases where periods of several months passed during which the Commission took no action. Furthermore, the Charity Commission does not take tough enough action in some of the most serious regulatory cases. It is also reactive rather than proactive, making insufficient use of the information it holds to identify risk. The Charity Commission needs to think radically about alternative ways of meeting its objectives with constrained resources. It also needs to make greater use of its statutory powers in line with its objective of maintaining confidence in the sector; and develop an approach to identify and deal with those few trustees who deliberately abuse charitable status.
