Book excerpt: During the 60s, the Eustis Directorate of the U.S. Army Air Mobility Research and Development Laboratory contracted with the Aviation Crash Injury Research (AvCIR) Group of the Flight Safety Foundation to define the Army aircraft crash environment and development design concepts and criteria to reduce injuries. For this study, the group investigated many accidents involving U.S. Army utility helicopters, conducted full-scale aircraft crash tests, evaluated aircraft crashworthiness, and developed crashworthiness design concepts. The examination showed that injuries, fatalities, and aircraft damage could have been reduced by improved design. The results were presented in USAAMRDL Technical Report 71-22, "Crash Survival Design Guide," which defines the hazards encountered in typical helicopter crashes. That document was used from the outset in design of the U.S. Army/Sikorsky UH-60A advanced utility helicopter with the objective of achieving an exceptional level of crashworthiness. To give some indication of the effectiveness of the crashworthy design achieved, we considered a fleet of 1,000 aircraft operating an average of 900 hours per aircraft per year. Our very conservative estimate shows that in 10 years of operation, 80 serious injuries could have been prevented and 200 lives saved. The crashworthy fuel system and crashworthy energy-absorbing landing gear and structure could save $58 million in material costs - $22 million saved by the fuel system and $36 million saved by the landing gear and structure. In addition, savings in personnel training and replacement would bring the estimated total savings to $78 million.

The study consisted of the development of a computer program (KRASH) and the verification of a mathematical model to predict the dynamic response during a survivable accident in which combined vertical and lateral impact velocities are present. Included in the study were a literature survey and evaluation, a detailed analysis of 32 accident cases, a drop test of a UH-1H helicopter with ground impact conditions of 23 fps vertical velocity and 18.6 fps lateral velocity, and parameter studies. It is concluded that program KRASH is capable of accurately predicting the dynamic responses during a multi-directional accident and that the program is a valuable tool with which to perform design tradeoff studies.

Inflatable restraints are a proven safety technology in the automotive world, and airbags are being developed for Army helicopters as well. Other applications in transport safety such as inflatable motorcycle helmet collars and inflatable restraint harnesses may be useful in aviation--research is underway in exciting novel areas. There are many questions to be answered before airbags and similar systems can be fielded in aircraft. Hot issues range from the unique characteristics of a helicopter crash pulse to the effects of unintended airbag deployment on injury and aircraft control. Tools useful in this research include computer modeling, anthropometric test devices, cadaver research, and flight simulation/testing. In December 1999, a workshop entitled "Inflatable Restraints in Aviation was held in Huntsville, Alabama, that brought together a multidisciplinary group of world experts in inflatable restraint technology and applications. The workshop was co-sponsored by the U.S. Army Aeromedical Research Laboratory, and The Technical Cooperation Program (TTCP), Subgroup U, Technical Panel 7 (Human Factors in Aviation). The emphasis of the meeting was on the potential need for inflatable restraints in aviation, and the special integration and safety problems unique to the aviation environment. The workshop was very well attended, and the scientific presentations excellent.

Highlights of recent developments covered in this Third Edition include: 1. The U.S. Supreme Court clarified the jurisdictional landscape for the better in Ford Motor Co. v. Montana Eighth Judicial District by emphatically rejecting the defendant manufacturer's claim that the litigation must "arise out of" the defendant's contacts with the forum state and re-affirming the stream of commerce doctrine. This unanimous Supreme Court decision is arguably the most significant development in helicopter crash litigation as it substantially minimizes the prospect of culpable manufacturing defendants' securing dismissal on jurisdictional grounds. 2. The "Helicopter Fuel System Safety" Amendment was enacted to require that all helicopters manufactured and delivered for use in the United States after April 5, 2020 must be equipped with crash resistant fuel systems (CRFS). There is no single greater recent safety improvement within the entire helicopter industry than the addition of CRFS to helicopters. 3. The Federal Officer Removal Statute was rejected as a basis for any aircraft manufacturing defendant's removal of a design defect case to federal court. The Ninth Circuit's decision in Riggs v. Airbus Helicopters, Inc. -- which the author briefed and argued - - laid to rest any notion that aircraft manufacturers are "agents of the FAA" as Airbus Helicopters strained to argue. The defendant sought a writ of certiorari before the U.S. Supreme Court which was summarily denied. 4. The global pandemic of 2020-21 engendered the widespread and continued use of virtual or remote depositions in civil discovery and helicopter crash litigation was no exception. 5. The universal social and business usage of electronic media has led to a corresponding explosion in the use of electronically-stored information (ESI) discovery. So-called e-discovery encompasses all manner of electronic communication including e-mails, social media, cell phone data and e- storage, all of which is proving fertile discovery grounds in helicopter crash litigation In addition to addressing in detail the foregoing developments, this Third Edition: Updates and "modernizes" Chapters 1 and 2 dealing with helicopter operation and common failure modes. The first of these tests, conducted as a crane drop, illustrated the energy absorption capability of the tapered-wall landing gear strut. It further showed that high accelerations may be induced in occupants under level impact conditions of the aircraft in which the design sinking speed for the gear is exceeded. The latter of these tests, conducted from droned flight, indicated that rotor blade impacts with obstacles induced loads into the mast-transmission system which were sufficient to fail the structure at the transmission supports. The crashworthiness of the OH-4A showed an improvement over previous aircraft tested; however, further improvements are definitely possible. This report recommends the means of such improvements and proposes their implementation through appropriate study and test programs. (Author).
