Book excerpt: El verdadero alcance de la Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual, y de la Ley 15/2022, de 12 de julio, integral para la igualdad de trato y la no discriminación, sólo se comprobará si se analiza a la luz de la Ley Orgánica 3/2007, de 22 de marzo, de igualdad efectiva de mujeres y hombres, y de la Ley Orgánica 1/2004, de 28 de diciembre, de medidas de protección integral contra la violencia de género, pues todas ellas componen un mismo corpus iuris.Desde esta perspectiva, la obra colectiva pretende, en primer lugar, delimitar conceptualmente la violencia que surge en el lugar de trabajo (real o virtual) o en la vida privada de las personas, pero redundando en el ámbito laboral. Esa delimitación facilitará la correcta introducción de las medidas que la norma exige a las empresas y Administraciones Públicas. En segundo término, armonizar los instrumentos de unas y otras (protocolos y códigos de conducta) ahora dedicados de forma principal a la lucha contra el acoso sexual y el acoso por razón de sexo y que deberán comprender todo tipo de conducta o comportamiento conceptualmente incluido en el ámbito de la violencia que surge en el trabajo o incide en él. En tercer lugar, determinar el rol de la negociación colectiva y de los planes de igualdad, además de sus interrelaciones entre ambos, a los efectos de completar el régimen jurídico de la tutela de las víctimas en cuanto trabajadoras o trabajadores desde las empresas y Administraciones para las que prestan servicios. Y, por último, incidir en la acreditación de la condición de víctima de violencia sexual o de una discriminación a los efectos de obtener la tutela jurisdiccional.
