Book excerpt: "The Institute for Energy and the Environment at Vermont Law School is pleased to present this Interim Print Version of our White Paper Series on "Implementing the Arctic Offshore Oil and Gas Guidelines in the United States and Canada." Interim in this context means that we plan to publish a final version in 2011 that takes into account reader comments and reflects selected developments after the fatal Deepwater Horizon-BP blowout and oil spill in the Gulf of Mexico that are not covered in the papers to date. In July and August 2010 we published the Overview and Four White Papers reproduced in this booklet [see ASTIS records: 71161, 71153, 71156, 71158, 71160]. Our objective was, and remains, to compare relevant U.S. and Canadian laws and regulations for ways in which they comport with the Arctic Offshore Oil and Gas Guidelines endorsed by the Arctic Council in 2009. More information on the white paper project is contained in the letter dated July 27, 2010, also reproduced in this booklet. The white papers as published this summer did not address in any detail the regulatory developments following the April 20 Gulf of Mexico blowout and spill. On the U.S. side it is worth noting that the Safety and Environmental Management Systems (SEMS) Regulations referenced on page 2 of the July 27, 2010, Overview have since been published in the Federal Register. In Canada, the National Energy Board "Arctic Offshore Drilling Review" process is ongoing. The final published version of these papers will incorporate selected developments on both of these fronts"

The AOOGG were prepared by the Protection of the Marine Environment Working Group (PAME) and are intended to define a set of recommended practices and outline strategic actions for consideration by those responsible for regulation of offshore oil and gas activities in the Arctic. As active participants in the Arctic Council, the United States and Canada have the potential to demonstrate model practices for offshore oil and gas development in their neighboring offshore areas of the Western Arctic Ocean, especially as each country reviews its procedures in light of the fatal April 2010 Deepwater Horizon blowout and explosion in the Gulf of Mexico. This paper outlines national laws and regulations existing at the time of the accident to suggest how both countries, as they revisit their procedures, can use the Arctic Council guidelines to more effectively regulate Operating Practices in offshore oil and gas development in the Western Arctic.

Differing political systems, legal traditions and societal beliefs with regard to energy security and economic development, environmental protection, legitimacy of decision making, and the ownership and respect of the rights of indigenous people, all affect how governance systems of oil and gas extraction are designed. Using a multidisciplinary approach and case studies from the USA, Norway, Russia, Canada, Greenland/Denmark and the EU, this book both examines the current governance of extraction and its effects and considers ways to enhance the efficiency of environmental management and public participation in this system.

According to Responding to Oil Spills in the U.S. Arctic Marine Environment, a full range of proven oil spill response technologies is needed in order to minimize the impacts on people and sensitive ecosystems. This report identifies key oil spill research priorities, critical data and monitoring needs, mitigation strategies, and important operational and logistical issues. The Arctic acts as an integrating, regulating, and mediating component of the physical, atmospheric and cryospheric systems that govern life on Earth. Not only does the Arctic serve as regulator of many of the Earth's large-scale systems and processes, but it is also an area where choices made have substantial impact on life and choices everywhere on planet Earth. This report's recommendations will assist environmentalists, industry, state and local policymakers, and anyone interested in the future of this special region to preserve and protect it from damaging oil spills.

Consequently, the already fragile Arctic marine environment has been further compromised. The Arctic coastal states, under the Ilulissat Declaration, agreed that UNCLOS will provide a legal basis for the regulatory framework in the Arctic, supplemented by Arctic Council soft-law. Consequently, the environmental issues in the Arctic, arising as a result of O&G activities, mainly have to be dealt under the discretion of the Arctic coastal states' regulations. By analysing current environmental regulation in the Arctic, the paper aims to discover if the framework can ensure that petroleum activities are carried out in an environmentally safe fashion. To make sure that the Arctic states can address the aforementioned issues, under national legislation, the paper will examine Russia's and Norway's petroleum regulations applicable to the Arctic. In the light of the performed analysis, the paper will propose to address the regulatory gaps created as a result of environmental issues arising from petroleum activities in the Arctic under the Arctic Framework Treaty. To address topical issues at the sub-regional level, an ecosystem-based management plan will be analysed, and suggesting its implementation on the Russian continental shelf.

On May 11th, 2010, the NEB announced that it would conduct a review of Arctic safety and environmental offshore drilling requirements (the Arctic Review). The Arctic Review will examine the best available information concerning the hazards, risks and mitigation measures associated with offshore drilling activities in the Canadian Arctic and measures to both prevent and respond to accidents and malfunctions.

Book excerpt: The Arctic Ocean region presents certain challenges to peaceful cooperation between states, particularly in the locations where ocean boundaries and ownership of the related resources are disputed. The establishment of Joint Development Zones (JDZs) for the development of offshore oil and gas resources in the Arctic Ocean can facilitate international cooperation over resource development where there are competing claims. These claims are generally based on continental shelf jurisdiction under the provisions of the United Nations Convention on the Law of the Sea (UNCLOS). There are several alternative dispute resolution measures available under UNCLOS, however, a number of states have preferred to adopt a JDZ as an interim measure to allow development. The significance of JDZs for the Arctic Ocean region is that they can allow peaceful cooperation and development where the specific circumstances of Arctic claims make it difficult for the respective states to agree on the maritime boundary.
