Available in PDF, EPUB and Kindle. Book excerpt: Over the years, Congress has enacted a variety of laws designed to encourage federal agencies to purchase U.S. supplies and services. These laws are commonly referred to as domestic preference laws or domestic source restrictions. Perhaps the best known of these laws is the Buy American Act, a 1933 law that established a statutory preference for U.S. supplies and construction materials. At the same time, Congress has approved a number of international agreements that open certain government procurements to goods and services from countries that are parties to those agreements. In addition, the Department of Defense (DOD) has entered into reciprocal procurement memoranda of understanding (MOUs) with some of its foreign counterparts, under which DOD may procure goods and services from those countries. Congress asked us to determine the effect of international agreements on the applicability of U.S. domestic source restrictions. In response, this report (1) identifies the current international trade agreements to which the U.S. is a party that contain government procurement provisions, as well as the reciprocal defense procurement MOUs, and (2) describes how these trade agreements and MOUs affect the applicability of selected domestic source restrictions.

Book excerpt: This bill would make statutory the definition of "American made," increase the domestic content requirement from 50% to 75%, and place limits upon the "inconsistent with the public interest" and "use outside of the United States" exceptions to the act. [...] The nationality of the contractor is not considered when determining if a product is of domestic origin.5 While the act appears to control most procurements of the federal government, it should be noted, when considering a particular procurement, that the application of the act may be controlled by other legislation or international agreement. [...] In contrast, under construction contracts, the test is applied to articles, materials, and supplies used by the contractor and subcontractors in constructing, altering, or repairing the building or work.14 In the case of supply contracts the test is applied to "end products."15. [...] The head of the procuring agency may waive the requirements of the act if a determination is made that the application of the act would be inconsistent with the public interest. [...] A federal agency is permitted to use a foreign product if the head of the agency determines that the cost of the lowest domestic product is "unreasonable."25.

Book excerpt: GAO reviewed the government's implementation of the multilateral Agreement on Government Procurement, which was meant to limit signatory governments' use of discriminatory procurement practices as barriers to trade. GAO found that, while the agreement was an important step toward less restrictive trade, it has had less commercial value than originally anticipated because: (1) foreign signatory governments opened a smaller value of procurements to international competition than was projected; (2) some foreign signatory governments did not comply with the agreement; (3) previous agreements and national practices had already opened to American competition procurements covered by the agreement; and (4) American firms were unable to competitively sell products demanded by foreign governments. The U.S. Government opened a greater value of procurements to foreign competition than did all other signatories. GAO also found that the Department of Commerce's efforts to familiarize American firms with the agreement were ineffective because: (1) budgetary constraints and an internal reorganization hampered such efforts; (2) Commerce did not make an effort to reach the firms most capable of benefiting from the agreement through their overseas representatives; and (3) of inefficiencies in Commerce's Trade Opportunities Program (TOP). In addition, GAO found that: (1) embassies devoted little time to efforts to monitor compliance with the agreement because they were unsure about what actions to take regarding noncompliance; and (2) information collection difficulties have prevented the U.S. Government from fully assessing the benefits of the agreement.
